MINUTES <br />HUGO PLANNING COMMISSION <br />April 24, 2003 <br />Call to Order <br />Chairperson Schumann called the meeting to order at 7:00 p.m. <br />PRESENT: Bailly, Kleissler, Malaski, McRoberts, Peltier, Rosenquist, Schumann <br />ABSENT: None <br />ALSO PRESENT: John Rask, Community Development Director <br />Michele Lindau, Planning Commission Secretary <br />Minutes of April 10, 2003 <br />Malaski made motion, Peltier seconded, to approve of the minutes of April 10, 2003 as submitted. <br />All Ayes. Motion carried <br />Bald Eagle Sportsman Association Amended CUP <br />The Planning Commission held a public hearing to consider the request of the Bald Eagle <br />Sportsman Association (BESA) to amend the conditional use permit for 6557 125th Street North <br />by removing condition 21, which states that the use of muzzleloaders are not permitted to use in <br />the facility. <br />The Community Development Director explained that BESA became non -conforming when the <br />zoning had changed from Agricultural to Rural Residential in 1999. A condition of the existing <br />conditional use permit prohibits the use of muzzleloaders at the facility. In researching the past <br />history of this site and the conditional use permit, staff could find no background information as <br />to why muzzleloaders were prohibited. <br />The City Attorney had reviewed the existing conditional use permit and the non -conforming status <br />of the operation and found that the City could amend the conditional use permit to allow muzzle <br />loading firearms, if it is found that the amendment would not substantially alter the nature of the <br />existing use or expand the non -conformity. <br />Chairman Schumann opened the public hearing. <br />Dennis Schreifels, 13125 Goodview Avenue North, said he was a member of BESA and was at <br />
