MINUTES HUGO PLANNING COMMISSION April 24, 2003 Call to Order Chairperson Schumann called the meeting to order at 7:00 p.m. PRESENT: Bailly, Kleissler, Malaski, McRoberts, Peltier, Rosenquist, Schumann ABSENT: None ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Planning Commission Secretary Minutes of April 10, 2003 Malaski made motion, Peltier seconded, to approve of the minutes of April 10, 2003 as submitted. All Ayes. Motion carried Bald Eagle Sportsman Association Amended CUP The Planning Commission held a public hearing to consider the request of the Bald Eagle Sportsman Association (BESA) to amend the conditional use permit for 6557 125th Street North by removing condition 21, which states that the use of muzzleloaders are not permitted to use in the facility. The Community Development Director explained that BESA became non -conforming when the zoning had changed from Agricultural to Rural Residential in 1999. A condition of the existing conditional use permit prohibits the use of muzzleloaders at the facility. In researching the past history of this site and the conditional use permit, staff could find no background information as to why muzzleloaders were prohibited. The City Attorney had reviewed the existing conditional use permit and the non -conforming status of the operation and found that the City could amend the conditional use permit to allow muzzle loading firearms, if it is found that the amendment would not substantially alter the nature of the existing use or expand the non -conformity.
