O'Reilly Auto Parts — Site Plan and Variances <br />buildings in this area should be oriented to the street with fully articulated street facades <br />(doors and windows) based on traditional downtown storefronts. The applicant is <br />requesting the front yard setback variances to place the building at the corner in an effort <br />to meet the downtown plan and design guidelines. <br />b. Unique Circumstances. The plight of property owner is due to circumstances unique <br />to the property not created by the landowner and; <br />The property is unique in that it is in the Central Business (C-1) zoning district with front <br />yard setback regulations and is also guided by the downtown plan and design guidelines. <br />The downtown plan and design guidelines encourages buildings to orient towards the <br />street to create a traditional downtown storefront design. In this case the property is a <br />corner lot adjacent to two streets. Since the property is a corner lot it has two fronts along <br />the streets and two sides to the north and east. The design guidelines encourage zero lot <br />line commercial buildings so they can be oriented to the streets. <br />In an effort to meet the downtown design guidelines the applicant is requesting the front <br />yard setback variances. <br />c. Character of Neighborhood. The variance, if granted, will not alter the essential <br />Character of the neighborhood. <br />Prior to the adoption of the downtown plan and design guidelines, there were buildings <br />that were placed further back on properties. Since then the City has adopted guidelines <br />that encourage buildings to orient to the streets and to anchor the corners at key <br />intersections like a traditional downtown. Highway 61 and 147h Street is identified as a <br />key intersection. <br />Although buildings in the area are not as close to the streets as the proposed building, <br />there are several in the area that line Highway 61. The applicant is providing articulated <br />facades along the streets with doors and windows to create a feel of a traditional <br />downtown storefront design. The variances will not alter the character of the area. <br />The property is within the Central Business (C-1) zoning district in an area guided by the <br />downtown plan and design guidelines. Although the required front yardsetback is 10 feet from <br />the property line, the guidelines encourage zero lot line setbacks and buildings anchor the corner <br />of key intersections. The applicant has tried to accomplish the intent of the design guidelines by <br />placing the building at the corner, this has resulted in the front yard variance requests. It is in <br />staff's opinion that the applicant has established practical difficulties in complying with the front <br />yard setback regulations. <br />(3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and <br />intent of this chapter and with the policies of the City's Comprehensive Plan. <br />The spirit and intent of the ordinance is to provide a reasonable amount of space between the <br />property line and building.
