MINUTES FOR THE PLANNING COMMISSION MEETING OF 01/28/98 <br />The meeting was called to order by Chair Peltier at 7:05PM. <br />PRESENT: Peltier, Rubenzer, Schumann, Kellison, Malaski, Harrison, Puleo <br />City Administrator, Robert A. Museus <br />Schumann made motion, Malaski seconded, to approve the minutes for the Planning <br />Commission meeting of December 17, 1997. <br />VOTING AYE: Schumann, Kellison, Malaski, Harrison, Puleo <br />ABSTAINED: Peltier and Rubenzer <br />Motion Carried. <br />SPECIAL USE PERMIT (LOWELL) <br />Peltier opened the public hearing regarding the request of William and Charles Lowell, <br />5444 140th Street North, for a Special Use Permit to operate a body shop and maintain <br />exterior storage on his property at the above address. The two acre property is zoned <br />industrial, and both uses are allowed upon issuance of a SUP. Mr. Chuck Lowell <br />addressed the Planning Commission and informed them of his intention to store <br />miscellaneous construction materials on the property, and to lease the building to a <br />number of tenants, one of which in an automobile repair shop that does minor body work, <br />and thus the need for the SUP. An adjacent resident stated that he was concerned with <br />the safety of the fence surround the property, and the appearance of the facility. The <br />property owner of Lot 2, Block 3, Oneka Estates expressed concern regarding the noise <br />and appearance of the property, and that he has had to call the Sheriffs Department <br />regarding the noise from the property late at night. Mr. Galen Carlson, owner of North <br />Country Auto, 5451 140th Street, expressed concerns regarding the operation of repair <br />shop at the location without a paint booth, and questioned how hazardous materials from <br />this site were to be handled. <br />Kellison made motion, Peltier seconded, to recommend approval of the SUP to William <br />and Charles Lowell, 5444 140th Street, for the operation of a body shop and maintenance <br />of limited exterior storage outside the building, subject to the following conditions: <br />1. No torch or open flame will be allowed within the building. <br />2. Additional open fencing and landscaping will be constructed on the north and west <br />property boundaries no later than July 1, 1998, in order to screen the exterior storage, <br />and other activities on the site, from view of adjacent residential properties. Said <br />screening and landscaping shall be reviewed and approved by the Planning <br />Commission. <br />3. The address of the property be changed to reflect its location off Finale Avenue North. <br />4. Exterior storage at the site will be confined to building materials only. <br />
