P.C. Meeting - April 2-6, 1995 <br />Page 2 <br />1. Maintenance of the monument and its easement shall be the <br />responsibility of the Duck Pass Homeowners Association. <br />2. The covenants of the Duck Pass Homeowners Association shall be amended <br />to provide for maintenance of the monument and its easement area, as <br />well as providing a funding mechanism for such maintenance. <br />3. At any time the monument falls into a state of repair, the Council may <br />terminate this special use permit and remove the monument subject only <br />to notice of the Council's intention, in advance, to the homeowners <br />association. <br />4. A fine of $500 should be imposed for failure to obtain permit. <br />AYE: Kellison, Schumann, Peltier <br />NAY: Miltz-Miller, Agness <br />Motion passed. <br />SPECIAL USE PERMIT/SHEPHERD OF THE FIELDS <br />Shepherd of the Fields Lutheran Church, 6000 148th St., Hugo has requested <br />a special use permit to construct a tower structure to hold a church bell <br />on their property at the above address. The structure will meet all <br />setback requirements. <br />Chairman Peltier opened the public hearing. No one from the public <br />commented. James Brevig, representative from the church stated that they <br />may include a cross to the top of the tower or to the sides. They do not <br />plan to use the structure for storage. <br />Motion made by Agness, seconded by Schumann to recommend approval of the <br />request of Shepherd of the Fields Lutheran Church to construct a bell <br />tower at 6000 148th St. <br />All aye, motion passed. <br />SPECIAL USE PERMIT/LESSARD-NYREN <br />Lessard/Nyren Utilties Incorporated, 17385 Forest Blvd. North, has <br />requested an SUP to maintain exterior storage as a principal use on their <br />property at the above address. Hugo City Code 320-5, Subd. N, states that <br />exterior storage becomes a principal use of a lot when the exterior <br />storage occupies 30% or more of the floor area of the existing principal <br />building on the lot and established the following standards for such use. <br />Chairman Peltier opened the public hearing. Gene Riopel, owner of the <br />property on the east was concerned about runoff into his field. <br />Lessard/Nyren stated they will create a swale to retain the water on their <br />property. The applicants are proposing to use the entire property, not <br />already used for structures or bituminous, as exterior storage. They will <br />not be installing additional bituminous. Material to be stored will be <br />only dry goods used for utility installation. Five to six foot pine trees <br />will be planted around the pond, adjacent to Forest Blvd., and on the <br />sides. Fencing will be installed prior to planting trees. The applicants <br />are willing to listen to neighbors complaints and work out solutions to <br />any problems. <br />
