Minutes - May 24, 1995 <br />Page 3 <br />Mr. Jerry Lovegren 8355, 122nd St', Hugo, has applied for a Special Use <br />Permit to construct a 40' X 63' accessory building on a lot adjacent to <br />his resideAce' The proposed building -is 2,520 sq. ft', where 1800 sq' ft. <br />is allowed. The building would be located within the shoreland district <br />of Round Lake which requires a 100' setback from the lake's ordinary high <br />watermark' The property lines on the site plan provided by' Mr. Lovegren <br />do not clearly define the setbacks of the proposed building' As an <br />option, the Planning Commission may wish to consider denying the special <br />use permit but granting the variance subject to Mr. Lovegren combining his <br />parcel into one lot of record. If the resulting combined parcel exceeds <br />20 acres in size, then a variance to the building size would not be <br />required. If the Planning Commission wishes to recommend approval of the <br />SUP, staff recommends special conditions. <br />The public hearing was opened. No one from the general public was present <br />to comment. Mr. Lovegren stated that the combined total of his two lots <br />is 17.65 acres. He stated that he will file the document with Washington <br />County in the fall to combine his two parcels which would eliminate the <br />necessity for a Special Use Permit. Mr. Lovegren stated he plants six <br />acres in alfalfa and needs this size building for storing his farm <br />equipment. <br />Commissioner Schumann felt that this was a reasonable request for an <br />agricultural use. Other Commissioners questioned the size of the proposed <br />building in an RR2 zone and what adverse effect there may be should the <br />property be subdivided in the future. <br />Motion made Kellison, seconded by Schumann to recommend approval of the <br />request of Jerry Lovegren, 8355 122nd St. for a variance to construct a <br />40' X 63' accessory structure on his property exceeding the allowable <br />limit by 720 sq, ft., subject to the following special conditions: <br />1. The two parcels be combined and recorded at Washington County into <br />one parcel no later than December 31, 1995. <br />2. A deposit of $3,000 be submitted to the City to ensure compliance. <br />VOTING AYE: Agness, Malaski, Schumann, Kellison, Rubenzer <br />VOTING NAY: Miltz-Miller <br />Miltz-Miller stated that her recommendation for denial was not a personal <br />issue, but felt a variance could only be granted as a hardship to the land <br />and not simply as an owners preference. <br />Miltz-Miller requested that the City Council and Planning Commissioners <br />receive copies of the state statutes regulating the granting of variances. <br />
