MINUTES <br />_1995 <br />The meetino was called to order at 7:08PM bv Chairman Peltier. <br />PRESENT: Schumann, Rubenzer, Malaski, Kellison, Peltier <br />ABSENT: Agness <br />Motion made by Schumann, seconded by Peltier to approve the minutes of <br />November 15, 1995, as amended. <br />Michael H. and Dorothy I. Masters, 15231 Elmcrest Ave., Hugo, have <br />reouested a minor subdivision of 22.09 acres. They are currently <br />purchasing the property on contract for deed. It is the Masters intent to <br />subdivide the parcel into one 11.97 acre parcel (tract A). on which they <br />currently reside, and one parcel 10.12 acre parcel (tract B), which they <br />intend to sell. The Masters and the fee owners of the property have <br />certified to the City that the contract for deed for the property will be <br />paid off at the time of subdivision. Both parcels meet the minimum <br />setback requirements of the City's agricultural district and the site <br />proposed for home construction will meet all setback requirements. <br />There was no comment from the public. <br />Motion made by Schumann, seconded by Malaski to recommend approval of the <br />request of Michael and Dorothy Masters to subdivide 22.09 acres into two <br />lots subject to the following conditions: <br />1. A permit from Rice Creek Watershed District. <br />2. Approval of the septic site location for tract B by Washington County. <br />3. Payment of the $500.00 parkland dedication fee. <br />All aye, motion passed. <br />TOMNITZ SPECIAL USE PERMIl <br />The Tomnitz, 7180 177th St., Hugo, has reouested a special use permit to <br />construct a detached accessory building of 2,240 sq. ft. at the above <br />address. This building would require a variance to Hugo City Code 320-5, <br />Subd. H (4), which states that no detached garage or other accessory <br />building shall be located nearer the lot line than the principal <br />building. The zoning ordinance currently allows 3600 sq. ft. of accessory <br />storage and 1,000 sq. ft. of garage space in the agricultural district. <br />The Tomnitz's currently have a total of 2,260 sq. ft. of garage and <br />accessory buildings on site. The proposed building, when added to the <br />existing buildings, is still under the combined square footage allowed. <br />Tomnitz's plan to use the building for storage of electrical equipment and <br />supplies used as part of an electrical contracting business. The proposed <br />building lies within the shoreland district which requires a 200 ft. <br />setback from ordinary high water level for all residential structures, of- <br />in <br />rin the case of commercial buildings, 400'. The OHM for Horseshoe Lake is <br />not clearly indicated on the site plan provided by the applicant. Though <br />it would appear that the pole structure meets the setback requirement for <br />residential buildings, it is unclear whether the building would meet the <br />setback for commercial buildings. <br />
