The meeting was called to order by Theodora Peltier at 7:00 PM. <br />PRESENT: Davis, Agness, Schumann, Rubenzer, Olson, Peltier <br />City Administrator, Bob Museus <br />Recording Secretary, Mary Ann Creager <br />ABSENT: Bob Oswald <br />Davis made motion, Schumann seconded, to approve the minutes for the <br />Planning Commission meeting of October 13, 1993, as submitted. <br />VOTING AYE: Davis, Schumann, Olson, Peltier <br />ABSTAINED: Agness and Rubenzer <br />Motion Carried. <br />APPOINTMENT OF VICE CHAIRPERSON <br />Peltier made motion, Rubenzer seconded, to appoint Dan Davis to serve as <br />Vice Chairperson for the Hugo Planning Commission <br />All aye. Motion Carried. <br />BURNING <br />A public hearing was held to consider an amendment to City Ordinances <br />110-16 through 110-31 to bring the City Code into conformance with State <br />Statute. Effective August 1, 1993, the State of Minnesota granted the <br />Minnesota Department of Natural Resources, Division of Forestry, sole <br />authority to regulate open burning in Minnesota. The revised ordinance <br />adopts the pertinent state statute, as well as imposes additional <br />restrictions to match those in existence in City ordinance at this time. <br />Specifically, the ordinance prohibits burning of dried vegetative material <br />in barrels, and requires permits during all seasons, where State Statutes <br />does not require permits on snow-covered ground. <br />The public hearing was opened, and Dennis Schreifels inquired about the <br />existing language for burning regulations in effect as of this time. He <br />suggested that regulations for burning be addressed in the next City <br />Newsletter, and that a handout be available at the time of application for <br />a burning permit. There was no further public comment, oral or written, <br />and the Planning Commission then discussed, at length, regulation for <br />barrel burning, and burning during the time of winter conditions. <br />Davis made motion, Agness seconded, to recommend adoption of the proposed <br />ordinance as submitted. <br />VOTING AYE: Davis, Agness, Schumann, Rubenzer, Olson <br />VOTING NAY: Peltier <br />Motion Carried. <br />Rubenzer made motion, Schumann seconded, recommending that the Fire Chief <br />supply burning permit applicants with pamphlets outlining rules and <br />regulations for open burning. <br />VOTING AYE: Davis, Agness, Schumann, Rubenzer, Olson <br />VOTING NAY: Peltier <br />Motion Carried. <br />
