thence south at right angles, 140 ft; thence westerly to a point on said <br />easterly right of -way line being 108.81 ft. southwesterly of the point of <br />beginning; thence northerly along said right-of-way line 108.81 ft to <br />point of beginning. The property in question is approximately one acre in <br />size and it is the intent of Mr. Pugh to sell the property for the <br />construction of a single family residence. The site in question is <br />bordered by a retail business district on the north, east and south, and <br />is bordered by an industrial district on the west. In making this request <br />the staff informed Mr. Pugh that to meet the front yard setback <br />requirement, a house would have to be located to the rear of the lot. The <br />property in question has 108 ft. on Highway 61 which would be primary <br />access to the site. In reviewing this request the Planning Commission <br />should carefully consider the following: <br />1. The desirability of spot zoning. <br />2. The limited retail business districts in the City of Hugo. <br />3. Other development activities in the surrounding area. <br />4. The impact of a residential development within an RB district. <br />If the Planning Commission feels that the request is consistent with the <br />comprehensive plan, and development in the surrounding area the <br />appropriate action would be a recommendation providing for an ordinance <br />rezoning the property as requested. <br />Commissioners Henry and Mezzano felt it would be inappropriate to spot <br />zone a small portion of an RB district to a residential zone. They stated <br />a rezoning of this type would set a precedent and it would be difficult to <br />deny a request of this type in the future. <br />Other commissioners felt that because of the size of the lot (one acre), <br />the fact that it is adjacent to existing homes on the north and south, and <br />there has not been a great deal of interest in commercial use in that area <br />the property would be better served as a homesite. <br />Motion made by Senkler, seconded by Barnes to recommend approval of the <br />request of Drexel Pugh to rezone a one acre parcel from RB to SFE (legal <br />description above, aka 35029-2810) for the following reasons: <br />1. The proximity to like development. <br />2.
