In light of the modifications made to the site plan and proposal for the <br />operation of the teen night club, we can see no objections to the approval <br />of the land use in question (special use permit) for the teenage night <br />club subject to the recommended special conditions. <br />Administrator Huber informed the commission that E.G. Rud prepared the <br />site plan and legal description for this request and has adequately <br />addressed the technical concerns expressed by the City at the previous <br />meeting. Mr. Murray Wright stated that if they plan to conduct outdoor <br />events or events for an age group other than normally allowed in the club, <br />they would apply for permits on an individual event basis. Mr. Doris <br />assured the commission that the existing lighting does illuminate the <br />current parking facilities, but if the parking lot to the east is to be <br />used, they will install additional lighting. Also, if the proposed <br />driveway on the south of the property is approved by MNDOT, the applicants <br />have agreed to install a light at the southwest corner. <br />The applicants have also indicated that they will use the door on the <br />north side of the building for the entrance and all other doors will be <br />used as emergency exits only. <br />Motion made by Barnes, seconded by Henry to recommend approval of the <br />special use permit request by Wil Harris Investments, Inc. to operate a <br />teen night club located at 17255 Forest Blvd. subject to the following <br />special conditions. <br />1. The maximum occupancy load of 710 will be identified and a signed <br />statement of such be posted in the entrance to the building in <br />question. <br />2. No entertainment is to be allowed outside the building without <br />receiving prior city council approval for each event. <br />3. That a minimum of 237 improved parking stalls including 5 handicapped <br />stalls be provided as required by law. <br />4. That the required parking lot shown approximately 75' east of the <br />existing building be of an approved surface (at least 2" to 6" of <br />class 5 dolomite or as recommended by the city engineer). <br />5. That the parking lot be properly plowed, maintained, and signed <br />indicating entrance and exit locations. <br />6. That at least 2 parking attendants be on duty while this facility is <br />open unless the parking lot is blacktopped and each parking stall <br />individually marked. <br />7. At least two law enforcement officers be present at all times while <br />the teen night club is open for business. <br />8. The approved site plan shall be a part of this permit. <br />9. The main entrance to the building be of a minimum width as required by <br />the fire marshal. <br />10. Two additional exits must also be provided while maintaining approved <br />operable exit door hardware. <br />11. Fire appliances must be installed in the building as per the fire <br />chief's requirements 10.301 (A) of the life safety code. <br />12. All parking areas shown on site plan shall be improved, kept plowed <br />and usable at all times while the facility is open. <br />13. No parking be allowed on Highway 61 or in the areas identified on the <br />site plan as fire lanes. <br />P.C. Minutes 12-27-89 2 <br />
