P.C. Minutes April 27, 1988 - page 3 <br />) <br />Mr. Brett Kostuch has made application to the City of Hugo for a special <br />use permit to allow for the boarding of two horses and construction of an <br />18' X 26' accessory building to serve as a horse barn. The property owned <br />by Mr. Kostuch is zoned RR 1 and contains approximately 5 acres in total <br />area. The property in question is generally defined as the North 300 ft. <br />of the south 970 ft. of the east 787.58 ft of the southeast 1/4 of the <br />southeast 1/4 of Section 19, T31N, R21W, except the east 50 ft. thereof. <br />Subject to Fenway Ave. (aka 14134 Fenway Ave. No.). <br />Mr. Kostuch withdrew his application on April 26, 1988. <br />Donald and Nancy Rieck have applied for a special use permit to allow for <br />the boarding of one horse and installation of a 12' X 15' horse barn on <br />their property identified generally as a part of Gov't lot 5, Section 35, <br />T31N, R21W, Washington County, Minnesota (aka 12718 Irish Ave. No.). The <br />property in question consists of 5 acres and is zoned RR2. Said property <br />is within 1,000' of Sunset Lake and this request must be reviewed by the <br />DNR. The applicants have not identified a fenced area or corral area to <br />contain the horse in question. If the planning commission recommends <br />approval of this special use permit we would suggest said approval be <br />subject to special conditions. <br />Chairman Senkler reviewed the request of Donald and Nancy Rieck with <br />commission members. The applicants were not present to comment on their <br />request. Mr. Senkler noted that there was no specified area for <br />containing the horse. Mr. Senkler explained that most residents on Irish <br />Ave. do have horses and this request would be consistent with the <br />surrounding area. <br />Commissioners had no objections with the request for one horse on the five <br />acre parcel. <br />Motion made by Jesinski, seconded by Barnes to recommend approval of the <br />request for a special use permit for Donald and Nancy Rieck to keep one <br />horse and construct a 12' x 15' horse barn at 12718 Irish Ave. No. subject <br />to the following conditions. <br />1. The number of horses permitted on site be limited to one. <br />2. The animal be restricted to the area identified as the corral or- <br />fenced <br />rfenced in area on the site plan. <br />3. No resubdivision of the five acre tract of land in question shall be <br />permitted or this special use permit shall be null and void. <br />4. No commercial use of the property shall be permitted. <br />5. All fees relating to the issuance of this permit shall be paid by the <br />applicant including the cost of recording at Washington County. <br />6. All activities on site shall not cause the altering of any <br />watercourse, ditch, or drainage system. <br />7. The applicant must provide access to the referenced site for periodic <br />inspection by the city to assure conformance with this permit. <br />8. Any revisions to the approved site plan must be reviewed by the <br />planning commission and city council. <br />
