SPECIAL MEETING HUGO PLANNING COMMISSION October 13, 1986 The meeting was called to order by George Atkinson at 7:00 PM. PRESENT: Bob Olson, Schoeller, Rudisill, Ray Olson, Atkinson ABSENT: Fashingbauer This special meeting was called to consider the variance of Peter Miller for a 5' variance from the 40' front yard setback. He is in the process of constructing a residence at 12530 Hilo Avenue and is in the RR2 zone. At this point in time, the footings and foundation walls have already been constructed. Chairman Atkinson recited the terms under which a variance should be granted - hardship because of the lay of the land and not a hardship of the property owner. Some of the Commission members felt the "hardship" now would be to have the property owner move the footings and walls. The contractor stated that the house was constructed according to the contour of the land, and to move the house back another 5' would create a real problem. Ray Olson made motion, Schoeller seconded, to recoomend approval of the 5' variance request of Peter Miller from the required 40' front yard requirement at 12530 Hile Avenue. We recommend Mr. Miller sign a hold -harmless agreement from any problems re- sulting from the granting of this variance. All aye. Motion Carried. Chairman Atkinson stated that he had a conversation with member, Ann Fashingbauer, and that as a result of her attending school to obtain a degree, there is a conflict for her to attend PC meetings. She stated that she will be resigning from the PC. Atkinson made motion, Rudisill seconded, that the Planning Commission pass a Resolution of Becognition to Ann Fashingbauer for her years of dedicated service to the City of Hugo. All aye.
