ZWWAL #5 <br />JUNE 309 1978 <br />Pursuant to the provisions of Ordinance 107 of the City of Hugo, entitled <br />"An Ordinance Establishing Mining Regulations To Provide for Orderly, Economic, and <br />Safe Removal of Sand, Gravel, Rook, Soil, and Other Natural Deposits and to Promote <br />the Public Health, Safety, Morals, and General Welfare in the City of Huge, Washington <br />County, Minnesota" a Mining Permit is issued to: <br />THOMAS E. LAVALLE <br />DRA LAVALLE EXCAVATING COMPANY <br />5564 152nd Street North <br />Hugo, Minnesota 55038 <br />for a period to expire one (1) year from the date hereof, unless sooner terminated <br />pursuant to the provisions of said Ordinance, and subject to the following oonditionss <br />1. There shall be full and complete compliance with the provisions of Hugo <br />Ordinance #107- <br />2* The scope of the Mining Permit shall be limited to the terms included in the <br />"Application for Mining Permit" for the area described by Minnesota Department <br />of Highways as Gravel Pit #3701, reoorded in the Washington County Offices, with <br />Paragraph 9.D deleted, filed together with coder letter dated December 4, 1972. <br />3. The requirement of posting an irrevocable letter of credit is reserved for further <br />consideration at the next renewal period. <br />4. That a performance bond in the amoant of =15,000.00, in a form approved by the <br />City Attorney, be filed with the City Clerk within thrity days (30) from the <br />date hereof. <br />5. The applicssit shall secure approval from the County of Washington for use of <br />County Road 8A as a hualing route, if required, and shall file proof of said <br />approval within sixty (60) days after the data hereof. <br />6. There shall be no mining, ss defined in said Ordinance, outside the area defined in <br />the Mining Area Map on file and of seoord with the City Engineer, without prior <br />approval of a modification of this MinlAg Permit by the City Council. <br />7. Other than equioment aotively used in the mining or hauling within the mining <br />area, no equipment or structure shall be parked, stored, erected, or otherwise <br />plaoed on said property. <br />8. An estimated annual inspection fee pursuant to the provisions of Section 701.04, <br />Schedule A, of Ordinance 107, in this asaamt of $235.00 shall be deposited with <br />the City Clerk, <br />9.
