MINUTES OF THE PROCEEDINGS <br />OF THE HUGO PLANNING COMMISSION <br />JANUARY 28, 1976 <br />The special meeting was called to order by Chairman Spitzer at <br />8: OOPM. Members present were: Spitzer, Ehret, Peloquin, and Peltier. <br />Johnson arrived at 8:02PM and Rosenquist at 8:04PM. Also attending <br />were Irene Leroux representing the City Council. <br />Shepherd of the Fields Lutheran Church <br />Vern Peloquin appeared with a request for a special use permit for <br />a church and parking facilities for the Shepherd of the Fields Lutheran <br />Church which would be built on land now owned by Mr. Peloquin; the land <br />Is zoned Single Family Urban, and under cultivation at this time. <br />Mr. Lester Winter, heading a delegation from the church, presented <br />a preliminary sketch plan. Peloquin showed a survey but stated that <br />the surveyer erroneously excluded Lot 5 instead of including it, and a <br />new survey did not arrive in time for this meeting. Peloquin and Winter <br />said they were attending, later this same evening, a meeting with the <br />Rice Creek Watershed District seeking their approval. Planning Commission <br />requested a full presentation by Peloquin and Winter, including sketch <br />showing size of building, describing easements and an up to date survey <br />for the February 11th Planning Commission meeting. <br />Motion made by Ehret, seconded by Peltier, to hold a public hearinP <br />on Wednesday evening, February 25th at 8:OOPM regarding a special use <br />permit for Vern Peloquin, for a church and parking facilities for the <br />Shepherd of the Fields Lutheran Congregation on the Peloquin property. <br />Motion carried. <br />Resolution <br />Mrs. Irene Leroux brought up the fact that the special use permit <br />for the day care center operated by Mrs. June Smith was due for reviewal <br />on Septembbr 1, 1975, but that Mrs. Smith did not appear before the Plan- <br />niAg Commission with her request for a variance regarding the septic sys- <br />tem until the meeting on September 7, 1975. Mrs. Leroux also stated that <br />approval was given for twelve children at the center, which was to inc- <br />lude her own children, and Leroux believes she is now caring for twenty <br />children; and she feels she is operating in violation of her special use <br />permit. She said this is the same type problem that we have with the Gun <br />Club and wonders how this type of problem should be treated. <br />Motion made by Ehret, seconded by Johnson, to pass a resolution, <br />that it has been the policy of the Planning Commission, in the past, that <br />If a special use permit has expired, that within a thirty day period, it <br />had been been considered to be in a grace period, but in the future, if <br />not in compliance on the date of expiration, the Planning Commission will <br />not consider an application as an extension of an existing permit. It <br />shall be the duty of the Planning Commission Secretary to notify the <br />Commissibn thirty days prior to expiration of any special use permit. <br />Voting for: Spitzer, Johnson, Ehret, Peloquin, and Rosenquist.
