MINUTES OF PROCEEDINGS OF THE <br /> HUGO PLANNING COMMISSION <br /> MARCH 12, 1975 <br /> The meeting was called to order at 8:05 P.M. by Chairman Spitzer. <br /> Members present were: Spitzer, Johnson, Ehret, Peloquin and <br /> Peltier. Also present were Bill Schwab, Washington County Planner. <br /> Motion made by Peltier, seconded by Johnson, to approve the minutes <br /> of the February 12, 1975 meeting as printed. Motion carried. <br /> RAY PELTIER - Special Use Permit <br /> Mr. Spitzer read letter from the City Attorney. The Planning <br /> Commission felt that this apartment was not utilized as a dwelling <br /> unit within the last 24 months, and that Special Use Permits cannot <br /> be granted for any items such as this. <br /> Motion made by Ehret, seconded by Johnson, recommending denial of <br /> this Special Use Permit on the grounds that the application for <br /> the permit is improper in the attorneys opinion dated March 3, 1975, <br /> and recommend that the City Clerk refund the filing fee. <br /> Members for: Peloquin, Peltier, Spitzer, Johnson and Ehret. Motion <br /> carried. <br /> NORMAN ROGSTAD - VARIANCE FOR DOG KENNEL <br /> Mr. Rogstad stated that he has six remaining dogs aged 7 through 13 <br /> years which he would like to keep until they die. He no longer breeds <br /> and sells dogs. Mr. Rogstad was told by the Police Chief that he would <br /> have to get rid of the dogs. Apparently there had been a complaint <br /> from one of his neighbors about the dogs barking. <br /> Mr. Spitzer asked Mr. Rogstad if he could prove that these dogs were <br /> in existence as of a year ago December. Mr. Rogstad stated that he <br /> could prove they were by Veterinary records. Mr. Spitzer explained <br /> that the dogs were grandfathered in but he cannot intensify the number <br /> or if one dies, reintensify. He also explained that he was subject to <br /> the Nuisance Ordinance which the Planning Commission has no control <br /> over. <br /> Motion made by Peloquin, seconded by Ehret, recommending that the <br /> City Council order the Zoning Administrator to issue a Certificate <br /> of Occupancy for lawful nonconforming use to Mr. Norman Rogstad at <br /> 6021 165th Street North for the purpose of kenneling two (2) dogs <br /> more than permitted in the Ordinance with the express understanding <br /> that this certificate shall expire upon the demise of the excess dogs <br /> or five years, which ever shall first occur. <br /> Members for: Peloquin, Peltier, Spitzer, Johnson and Ehret. Motion <br /> carried. <br />
