CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION 2016 - <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />VICTOR GARDENS NORTH VILLAGE 7TH ADDITION ON PROPERTY <br />LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST <br />AVENUE NORTH. <br />WHEREAS, Kettler Construction, Inc. has requested approval of a final plat for "Victor <br />Gardens North Village 7th Addition" to allow the construction of 33 townhome units on <br />the 8.51 -acre property legally described as follows: <br />Outlot A and Outlot B, Victor Gardens North Village 51 Addition, <br />according to the recorded plat thereof, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a <br />duly called public hearing and recommended approval of the preliminary plat and PUD; <br />and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on <br />May 16, 2016. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY 7HE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Kettler Construction, for a final plat, subject to the following conditions: <br />1. A final plat is approved to allow construction of 33 townhome units, in accordance <br />with the overall grading and utility plans dated April 18, 2016, and the final plat <br />graphics dated May 12, 2016, except as amended by this resolution. <br />2. The final plat shall be subject to and the development shall substantially comply with <br />all plans and conditions of the PUD Amendment and Preliminary Plat approvals <br />(Resolutions # 2016-8 and #2016-9) granted by the City Council on May 16, 2016, <br />except as amended by this resolution. <br />3. The final plat shall be subject to the Victor Gardens PUD concept approvals <br />(Resolution #2000-47) and Victor Gardens North PUD approvals (Resolutions <br />#2005-05 and #2005-06), except as amended. <br />4. The developer must comply with all of the conditions outlined in the City Engineer's <br />memo dated April 21, 2016 and June 2, 2016. <br />
