Cu -6J v �_X4r may, /1Vr"^C <br />7.27.09 Draft <br />AMENDMENT TO LEASE <br />THIS AMENDMENT TO LEASE ("Amendment") is made this7llay of t< <br />9 by and between THE CITY OF HUGO, a Minnesota municipal corporation ("Lessor" , <br />and BRUCE A. BERNIN and VIRGINIA R. BERNIN, husband and wife (collectively, <br />"Lessee"). <br />RECITALS <br />A. Lessor, as lessor, and Lessee, as lessees, are parties to that certain Lease dated May 7, <br />2002 (the "Lease") relating to the residential home located at 6540 Greene Avenue North, Hugo, <br />MN 55038. <br />B. Lessor and Lessee desire to amend the Lease as specifically set forth herein. <br />NOW, THEREFORE, in consideration of the foregoing recitals and for other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties <br />hereto hereby agree as follows: <br />1. Recitals. The foregoing recitals are true and correct, and are hereby incorporated herein <br />and made a part hereof. <br />2. Definitions. Any term or phrase as used herein with an initial capital letter shall have the <br />meaning as defined herein, or if not so defined, shall have the meaning as set forth in the Lease, <br />as amended. <br />3. Amendments to Lease. The Lease is hereby amended and supplemented as follows: <br />a. Amendment to Section I — Address of Premises. The address for the premises is <br />hereby amended to be 6540 Greene Avenue North, Hugo, Minnesota. <br />b. Amendment to Section II — Use of Premises. Lessee shall not use the premises <br />except for residential purposes. The premises shall no longer be used for the operation of a <br />tree farm. <br />C. Amendment to Section III - Extension of Term. The term of the Lease is hereby <br />extended for an additional five (5) years. The term of the Lease shall expire on June 30, <br />2017. <br />d. Amendment to Section III - Rent for Extension of Term. Lessee shall pay to <br />Lessor, $44,750.00 as rent for the five (5) year extension of the term which shall be payable <br />in monthly installments of $745.83 due, in advance, commencing on July 1, 2012 and <br />continuing on or before the first day of each month thereafter through June 1, 2017. There <br />shall be no early termination fees due to Lessee upon commencement of the five (5) year <br />extension term. <br />6� <br />
