Barnhart Variance <br />Page 2 <br />4. ANALYSIS: <br />A. Surrounding Land Use and Zoning <br />The surrounding properties are zoned Future Central Business (FCB) and classified as Mixed Use (MIX) <br />in the Land Use Plan. The properties are occupied by single family homes on narrow lots. <br />B. Setback Variance <br />The City Code requires a ten foot side yard setback. The applicant is proposing a side yard setback of <br />three feet. <br />5. VARIANCE STANDARDS: <br />The Board must review the requested variances with the standards outlined in Section 90-38 of the land <br />use regulations. Staff used these standards to review the variance request and finds the following: <br />(1) Law The variance as requested is permissible by law. <br />The proposed variance is permissible by law. <br />(2) Practical Difficulties. The applicantfor a variance shall establish that there are practical <br />difficulties in complying with the provisions of the zoning regulations. The term "Practical <br />Difficulties" as used in the granting of a variance means: <br />a. Reasonable Use. The property owner proposes to use the property in a reasonable manner <br />not permitted by the zoning ordinance and, <br />The applicant is requesting to construct a 180 square foot addition to the northwest corner of the <br />existing house. <br />The applicant is requesting to use the property in a reasonable manner. <br />b. Unique Circumstances. The plight of property owner is due to circumstances unique to the <br />property not created by the landowner and, <br />The setbacks for zoning districts are set for required minimum lot widths. The minimum lot <br />width in this zoning district is 80 feet. The property is unique in that it is a narrow lot (50 feet <br />wide) with an existing home that has been constructed three feet from the west side property line. <br />The home currently has a porch that is connected to the home and is located approximately nine <br />feet from the property line. The applicant is requesting to expand the finished porch and match <br />the home's side yard setback at three feet. <br />c. Character of Neighborhood. The variance, if granted, will not alter the essential character <br />of the neighborhood <br />2 <br />
