RESOLUTION 2016 - <br />APPROVING A VARIANCE FOR APRIL BARNHART IN THE FUTURE CENTRAL <br />BUSINESS ZONING DISTRICT ON PROPERTY LOCATED AT 5368 145TH STREET NORTH <br />WHEREAS, April Barnhart has requested approval of a variance to allow a three foot side yard setback, <br />where City ordinance requires a ten foot side yard setback, to expand a finished porch on her home. <br />THAT PART OF THE SW1/4 OF NW % OF SECTION 20, TOWNSHIP 31, PANGE 21, BEGINNING <br />AT A POINT 230 FEET WEST OF THE SW CORNER OF LOT 7, BLOCK 7 OF THE VILLAGE OF <br />HUGO, WASHINGTON COUNTY, MINNESOTA; THENCE RUNNING NORTH 150 FEET; <br />THENCE WEST 50 FEET; THENCE SOUTH 150 FEET; THENCE EAST 50 FEET TO THE PLACE <br />OF THE BEGINNING. <br />WHEREAS, the Board of Zoning has reviewed said variance at a duly called public hearing on June 9, <br />2016, and recommends approval with the following findings: <br />The requested variance is permissible by law. <br />2. Because of circumstances unique to the property there are practical difficulties on meeting the <br />ordinance. <br />3. The granting of the variance would be in keeping with the spirit and intent of the ordinance. <br />4. The applicant is proposing to use the property in a reasonable manner and construction of an <br />addition is allowed in the City. <br />5. The proposed variance would not alter the character of the area. <br />6. The subject property is not within a floodplain. <br />7. The subject property is served by municipal sewer and water. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the variance request of April Barnhart to <br />allow a three foot side yard setback, where City ordinance requires a ten foot side yard setback, to <br />expand a finished porch on her home. <br />ADOPTED by the City Council this 20th day of June, 2016. <br />Tom Weidt, Mayor <br />ATTEST: <br />Michele Lindau, City Clerk <br />
