CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT Memorandum TO: Parks Commission FROM: Shayla Syverson, Economic Development/ Parks Intern DATE: July 8th, 2009 SUBJECT: Park Rules Existing City Codes: Agenda # gma Alcoholic Beverages "No person shall consume liquor or 3.2 percent malt liquor on a public highway, public park, or other public space, or on the premises of an off -sale license holder, without the written consent of the city council." -Sec. 6-3 b Hours "It shall be unlawful for any person or organization, other than a police officer serving the city, either directly or indirectly, to use, occupy or pass through or on any public park in the city between the hours of 11 pm and 6am." -Sec. 54-20 Dogs "All dogs that are within an active city park or on a public sidewalk or trail shall be under the physical control, by leash, of the owner, a member of the owner's immediate family, or a person designated by the owner. For the purposes of this section, an active park shall include any park designated by the parks commission as active and as listed in the city's parks plan." -Sec. 10-34 (a) "No person shall allow a dog to run at large at any time within an active city park." —Sec. 10-34 (b) *Running at large in all areas is prohibited by Sec. 10-31 (a) Dogs as Nuisances a) Unlawful acts or conditions. The following are public nuisances and unlawful: (1) Any dog that damages property (that is not property of the owner), including plantings, lawns or structures, or that deposits fecal matter off of the owner's property that the owner fails to remove promptly to his own property or to an approved disposal location. (2) Any dog that, without provocation, chases, molests or approaches pedestrians or bicyclists in a threatening manner upon the streets, sidewalks, right-of-way, or any public property, or habitually chases automobiles on the public streets or highways.
