Agenda 7,�: <br />TO: <br />FROM: <br />DATE: <br />SUBJECT: <br />CITY OF HUGO <br />COMMUNITY DEVELOPMENT DEPARTMENT <br />Memorandum <br />Parks Commission <br />Shayla Syverson, Economic Development/ Parks Intern <br />July 8th, 2009 <br />Park Rules <br />Existing City Codes: <br />Alcoholic Beverages <br />"No person shall consume liquor or 3.2 percent malt liquor on a public highway, <br />public park, or other public space, or on the premises of an off -sale license <br />holder, without the written consent of the city council." -Sec. 6-3 b <br />Hours <br />"It shall be unlawful for any person or organization, other than a police officer <br />serving the city, either directly or indirectly, to use, occupy or pass through or on <br />any public park in the city between the hours of 11 pm and 6am." -Sec. 54-20 <br />Dogs <br />"All dogs that are within an active city park or on a public sidewalk or trail shall be <br />under the physical control, by leash, of the owner, a member of the owner's <br />immediate family, or a person designated by the owner. For the purposes of this <br />section, an active park shall include any park designated by the parks <br />commission as active and as listed in the city's parks plan." -Sec. 10-34 (a) <br />"No person shall allow a dog to run at large at any time within an active city park." <br />—Sec. 10-34 (b) *Running at large in all areas is prohibited by Sec. 10-31 (a) <br />Dogs as Nuisances <br />a) Unlawful acts or conditions. The following are public nuisances and unlawful: <br />(1) Any dog that damages property (that is not property of the owner), including <br />plantings, lawns or structures, or that deposits fecal matter off of the owner's <br />property that the owner fails to remove promptly to his own property or to an <br />approved disposal location. <br />(2) Any dog that, without provocation, chases, molests or approaches <br />pedestrians or bicyclists in a threatening manner upon the streets, sidewalks, <br />right-of-way, or any public property, or habitually chases automobiles on the <br />public streets or highways. <br />
