The city council has determined that regulation of the use of public park property is <br />necessary to protect the health and safety of persons and property within the city. <br />(b) Definitions. The following words, terms and phrases, when used in this article, shall have the <br />meanings ascribed to them in this subsection, except where the context clearly indicates a <br />different meaning: <br />Active park means any public park designated by the Parks, Recreation and Open Space <br />Commission to be an active park, which may include a public recreational facility, athletic facility, <br />playground, campground, or picnic area. <br />Passive park means any public park designated by the Parks, Recreation and Open Space <br />Commission to be a passive park, which is of limited improvements and intended for passive use. <br />Public place of interest means a parcel of land in the city now or hereafter owned or controlled <br />by the city. <br />Unimproved park means any designated public park that is in a natural, unimproved state. <br />(Prior Code, § 180-010; Ord. No. 2010-448, § 1, 11-15-2010) <br />Sec. 54-20. - Limitation of hours of use. <br />It shall be unlawful for any person or organization, other than a police officer serving the city, <br />either directly or indirectly, to use, occupy, or pass through or on any public park in the city between <br />the hours of 11:00 p.m. and 6:00 a.m. <br />(Prior Code, § 180-020) <br />Sec. 54-21. - Posting of hours. <br />The city may cause the limitation of hours of usage to be posted on each or any public park, but <br />the failure to so post, or the failure to replace defaced or damaged postings, shall not limit the scope <br />1 of 3 9/5/2013 2:54 PM <br />
