Park Dedication Policy <br />TO: City of Hugo Parks, Recreation and Open Space Commission <br />FROM: Shayla Syverson, Parks Planner <br />DATE: February 6, 2015 for the Parks Commission Meeting of February 11, 2015 <br />Introduction <br />At their meeting of September 20, 2010, the City Council made changes to the Park Dedication Policy. It <br />was requested that the policy be reviewed after four years. At that time, the policy was changed to include <br />a matrix to calculate land dedication based on density, remove the requirement for commercial and <br />industrial development, and to add an appeal process. <br />2010 Discussion <br />The Parks Commission discussed the Parks Dedication Policy at their July 14, August 11, and September <br />8, 2010 meetings. At the September 8, 2010 meeting, staff presented an analysis of future development <br />and potential park dedication. It was found that properties guided commercial or business park <br />development accounted for approximately 5% of developable acres in Hugo while residential accounted for <br />44% of developable acres. Agricultural, which may in the future be guided as residential, makes up an <br />additional 45%.' The Parks Commission unanimously recommended that changes include adding a matrix <br />formula to define density and percentage of land to be dedicated, adding an appeal process to pay a <br />percentage of land by fair market value, and continuing to require commercial and industrial dedication. <br />The Economic Development Authority (EDA) recommended that commercial and industrial developments <br />not be required to pay park dedication. A public hearing was held at the Planning Commission meeting on <br />October 28, 2010, and the Planning Commission unanimously recommended including a requirement to <br />charge commercial and industrial property development a park dedication fee. <br />At their meeting of November 15, 2015, the City Council discussed the three recommendations. The City <br />Council ultimately included the EDA's recommendation to not require a parkland dedication fee on <br />commercial and industrial land, and to review it again in four years. <br />Review of the Changes <br />Appeal Process <br />A formal appeal of park dedication requirements has not been requested by a developer since it was <br />provided for in the changes made in 2010. Staff has been able to work with applicants to ensure that <br />dedication is reasonable to the developer but also fits the park needs of the City of Hugo. It is beneficial <br />to continue to have the process in place by ordinance in case there is a dispute in the future. <br />Developable acres can be found in Chapter 4 of the City of Hugo 2030 Land Use Plan. <br />
