CITY OF HUGO WASHINGTON COUNTY, MINNESOTA RESOLUTION 2016-9 APPROVING PRELIMINARY PLAT FOR KETTLER CONSTRUCTION, INC. FOR "VICTOR GARDENS NORTH VILLAGE 7T" ADDITION" ON PROPERTY LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH WHEREAS, Kettler Construction, Inc. has requested approval of a preliminary plat to allow construction of 33 townhome units on the 8.51-acre property legally described as follows: Outlot A and Outlot B, Victor Gardens North Village 5rh Addition, according to the recorded plat thereof, Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Kettler Construction, Inc. for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 33 townhomes in accordance with the plans received by the City on March 30, 2016, April 15, 2016, April 21, 2016, and April 22, 2016, except as amended by this resolution. 2. Approval is contingent upon the City Council approval of the requested PUD amendment. 3. The development shall be consistent with the Victor Gardens PUD concept plan approvals (Resolution # 2000-47) and Victor Gardens North PUD approvals (2005-05 and 2005-06), except as otherwise noted herein. 4. Outlot A shall be owned and maintained by the Home Owners Association (HOA). 5. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 6. Prior to the release of the final plat for recording, the developer must comply with the following conditions. a. The developer must comply with all conditions outlined in the City Engineer's memos dated April 21, 2016.
