CITY OF HUGO <br /> WASHINGTON COUNTY, MINNESOTA <br /> RESOLUTION 2016-9 <br /> APPROVING PRELIMINARY PLAT FOR KETTLER CONSTRUCTION, INC. <br /> FOR "VICTOR GARDENS NORTH VILLAGE 7T" ADDITION" ON PROPERTY <br /> LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST <br /> AVENUE NORTH <br /> WHEREAS, Kettler Construction, Inc. has requested approval of a preliminary plat to <br /> allow construction of 33 townhome units on the 8.51-acre property legally described as <br /> follows: <br /> Outlot A and Outlot B, Victor Gardens North Village 5rh Addition, <br /> according to the recorded plat thereof, Washington County, Minnesota. <br /> WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br /> Public Hearing and recommends approval; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br /> request by Kettler Construction, Inc. for a preliminary plat, subject to the following <br /> conditions: <br /> 1. A preliminary plat is approved to allow the creation of 33 townhomes in accordance <br /> with the plans received by the City on March 30, 2016, April 15, 2016, April 21, <br /> 2016, and April 22, 2016, except as amended by this resolution. <br /> 2. Approval is contingent upon the City Council approval of the requested PUD <br /> amendment. <br /> 3. The development shall be consistent with the Victor Gardens PUD concept plan <br /> approvals (Resolution # 2000-47) and Victor Gardens North PUD approvals (2005-05 <br /> and 2005-06), except as otherwise noted herein. <br /> 4. Outlot A shall be owned and maintained by the Home Owners Association (HOA). <br /> 5. Park dedication requirements for this site have been met with previous additions. No <br /> additional park dedication is required for this phase. <br /> 6. Prior to the release of the final plat for recording, the developer must comply with the <br /> following conditions. <br /> a. The developer must comply with all conditions outlined in the City Engineer's <br /> memos dated April 21, 2016. <br />
