CITY OF HUGO <br /> WASHINGTON COUNTY, MINNESOTA <br /> RESOLUTION 2016-10 <br /> APPROVING A FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR D.R. <br /> HORTON, INC.—MINNESOTA FOR CLEARWATER COVE 2"d ADDITION <br /> WHEREAS, D.R. Horton, Inc. —Minnesota, has requested approval of a final plat for the <br /> property legally described as follows: <br /> Outlot G, Clearwater Cove <br /> WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a duly <br /> called public hearing and recommended approval of the preliminary plat and PUD; and <br /> WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on August <br /> 3, 2015. <br /> NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br /> OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, <br /> Inc. —Minnesota, for a final plat, subject to the following conditions: <br /> 1. The final plat is approved to allow the creation of 27 single family lots, in accordance <br /> with the plans and application received by the City on March 25, 2016, except as <br /> amended by this resolution. <br /> 2. The development shall substantially comply with all plans and conditions of the PUD and <br /> preliminary plat approval granted by the City on August 3, 2015. <br /> 3. Development standards shall comply with Resolution 2015-38 and 2015-39, as amended. <br /> 4. The developer shall comply with all conditions outlined in the City Engineer's memo <br /> dated July 16, 2015, August 12, 2015, and May 11, 2016, and revisions required in <br /> "redlined" comments from the City Engineer. <br /> 5. The developer shall design and install a stormwater re-use system for irrigation of the <br /> individual lots. <br /> 6. The developer shall establish a property owners association for the development to <br /> own/operate/maintain common elements, landscaping, and the water re-use system. <br /> 7. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in the <br /> plans shall be installed, prior to the release of the letter of credit for the development. <br /> 8. The landscaping planned for the plat shall be installed in one phase. The developer shall <br /> take proper precautions to protect the trees as the homes are being built. <br />
