Page 4 <br />permit may expire, a healthcare issue generally does not and there may be an unfavorable response <br />from permit holders. <br />Cities that wish to opt out of this law must pass an ordinance or resolution to do so, which requires a <br />public hearing through the Planning Commission and an approval of a resolution by the City <br />Council. <br />4. CONCLUSIONIRECOMMENDATION: <br />The law goes into effect September 1, 2016 and automatically applies to all cities that do not <br />opt out or don't already allow temporary family health care dwellings as a permitted use under <br />their local ordinances. <br />Staff recommends that the Planning Commission discuss the temporary family health care <br />dwelling ordinance and provide staff with comments. Because the new law alters the City's level <br />of zoning authority and the structures have the potential to change the character of the area, staff <br />recommends opting out of the temporary family health care dwelling statute. <br />Attachments: <br />1.
