Page 4 <br />Cities that wish to opt out of this law must pass an ordinance or resolution to do so, which requires a <br />public hearing through the Planning Commission and an approval of a resolution by the City <br />Council. <br />4. CONCLUSION/RECOMMENDATION: <br />The law goes into effect September 1, 2016 and automatically applies to all cities that do not opt out <br />or don't already allow temporary family health care dwellings as a permitted use under their local <br />ordinances. <br />Staff recommends that the City Council discuss the temporary family health care dwelling <br />ordinance and provide staff with comments. Because the new law alters the City's level of <br />zoning authority and the structures have the potential to change the character of the area, staff <br />recommends opting out of the temporary family health care dwelling ordinance. <br />Attachments: <br />1.
