RESOLUTION 2016-15 <br /> APPROVING A VARIANCE FOR APRIL BARNHART IN THE FUTURE CENTRAL <br /> BUSINESS ZONING DISTRICT ON PROPERTY LOCATED AT 5368145TH STREET NORTH <br /> WHEREAS,April Barnhart has requested approval of a variance to allow a three foot side yard setback, <br /> where City ordinance requires a ten foot side yard setback,to expand a finished porch on her home. <br /> THAT PART OF THE SWUM OF NW Y OF SECTION 20,TOWNSHIP 31,PANGE 21,BEGINNING <br /> AT A POINT 230 FEET WEST OF THE SW CORNER OF LOT 7, BLOCK 7 OF THE VILLAGE OF <br /> HUGO,WASHINGTON COUNTY,MINNESOTA; THENCE RUNNING NORTH 150 FEET; <br /> THENCE WEST 50 FEET; THENCE SOUTH 150 FEET;THENCE EAST 50 FEET TO THE PLACE <br /> OF THE BEGINNING. <br /> WHEREAS, the Board of Zoning has reviewed said variance at a duly called public hearing on June 9, <br /> 2016,and recommends approval with the following findings: <br /> 1. The requested variance is permissible by law. <br /> 2. Because of circumstances unique to the property there are practical difficulties on meeting the <br /> ordinance. <br /> 3. The granting of the variance would be in keeping with the spirit and intent of the ordinance. <br /> 4. The applicant is proposing to use the property in a reasonable manner and construction of an <br /> addition is allowed in the City. <br /> 5. The proposed variance would not alter the character of the area. <br /> i <br /> 6. The subject property is not within a floodplain. <br /> 7.
