-T l <br />MEMORANDUM of AGREEMENT <br />City of Hugo and Rice Creek Watershed District <br />Memorandum of Agreement Regarding Maintenance of <br />Anoka/Washington Judicial Ditch No.2 <br />This Memorandum of Agreement ("MOA") is entered into by the City of Hugo (Hugo) <br />and the Rice Creek Watershed District ("RCWD"), political subdivisions of the State of <br />Minnesota. <br />WHEREAS, Anoka/Washington Judicial Ditch No.2 ("JD2") is a public ditch system <br />lying within the Cities of Hugo and Forest Lake, Washington County, Minnesota; and <br />WHEREAS, the RCWD is the watershed management organization for the drainage area <br />of JD2 within the meaning of Minnesota Statutes Chapter 103B and the JD2 drainage authority <br />within the meaning of Minnesota Statues Chapter 103E; and <br />WHEREAS, on December 15, 2004, the RCWD Board of Manager adopted findings <br />addressing an April 10, 2002, petition for repair of JD 2; and <br />WHEREAS, the findings stated that, among other actions, the RCWD would complete a <br />program of minor maintenance of JD2 currently underway to remove impediments to flow and <br />provide positive drainage through the system and would "explore" future maintenance being <br />turned over to the City of Hugo with an annual budget of $40,000; and <br />WHEREAS, the RCWD and Hugo entered into an initial memorandum of agreement for <br />the maintenance of Ancka/Washington Judicial Ditch No. 2 in June of 2012 and said agreement <br />will expire on December 31, 2016; and <br />WHEREAS, Hugo has conducted minor maintenance pursuant to the terms of the <br />memorandum of agreement; and <br />WHEREAS, Hugo wishes to continue to undertake minor maintenance of JD2 with <br />RCWD reimbursement, and Hugo and the RCWD believe there are administrative and other <br />benefits if Hugo does so; <br />NOW, THEREFORE BE IT RESOLVED that Hugo and the RCWD enter into this MOA <br />to provide for Hugo to undertake minor maintenance of JD2 and agree as follows: <br />Until all funds specified in Paragraph 4 below have been expended for the period of <br />January 1, 2017 to December 31, 2021, Hugo will assume responsibility to continue a <br />program of minor maintenance as follows: <br />a. Hugo shall develop an annual work plan and budget for submission to the District <br />for review and approval no later than January 1, commencing January 1, 2017, of <br />each calendar year during the term of this agreement. <br />
