Agenda Number <br />CITY OF HUGO COMMUNITY <br />DEVELOPMENT DEPARTMENT <br />Memorandum <br />TO: Bryan Bear, City Administrator <br />FROM: Rachel Leitz, Community Development Assistant <br />SUBJECT: An Ordinance Repealing Hugo City Code, Chapter 38, Article II, <br />Individual Sewage Treatment System <br />DATE: January 31, 2017 for the City Council meeting of February 6, 2017 <br />1. BACKGROUND: <br />At the end of 2016, City staff sat down with the Washington County Public Health and <br />Environment department to discuss the future of the City's Individual Sewage Treatment System <br />ordinance. The City has been in an agreement with Washington County which stipulates that <br />Washington County is the body in which Hugo residents go through to receive approval of their <br />proposed septic systems. This agreement between the County and the City has worked out very <br />well and it was in City staff's opinion to continue with this process. Washington County stated <br />that the City's ordinance no longer complied with requirements to allow such a process and <br />therefore needed to be updated. After further discussions with Washington County, it was stated <br />that upon a City repealing their Individual Sewage Treatment System ordinance, permitting and <br />approving sewage treatment systems would automatically be the County's responsibility. The <br />County would still communicate with the City when permits are submitted and the City would <br />still have a way to voice any concerns on applications, including all land use variances, which <br />are required to go through the City variance procedure. <br />2. CONCLUSION/RECOMMENDATION: <br />City staff discussed the City's Individual Sewage Treatment System Ordinance and found no <br />need to create a new City ordinance when the agreement with Washington County has been <br />successful. Staff recommends approval of an ordinance repealing Hugo City Code, Chapter 38, <br />Article II, Individual Sewage Treatment System. <br />Attachments: <br />1. Ordinance <br />
