Email Scott,ahlgren@nmss.orq <br />Minneapolis MN 55415 Phone # 763.228.0730 <br />Term of Permit June 12, 2016 Fee No fee required <br />GRANT OF SPECIAL USE PERMIT <br />Washington County (herelnaftercalled the County) hereby grants to ScottAhigren/MS Society (hereinafter called <br />the Permittee) a nonexclusive Permit to conduct a special event on the Hardwood Creek Trail under the terms and <br />conditions as set forth below and as detailed in the Permittee's Special Use Request documents dated 1/12116 and <br />attached hereto and hereby made a part of this Permit as Exhibit A. Fees shall be as set forth and specified In <br />Exhibit A. <br />Limitation to Described Pumose and Term - The premises shall be used by Permittee solely to conduct a bike <br />tour on the Hardwood Creek Trail between 10:00 am and 3:00 pm. <br />Special Use Pollcy–Permittee acknowledges and agrees to abide by Washington County Parks Special Use <br />Policy and Washington County Parks Ordinance #174. Permittee understands that it will be denied the special use if <br />said policy and ordinance are not followed. <br />Revocation and Termination - If the Permittee utilizes the subject property for purposes other than described In <br />this Permit, this Permit will terminate Immediately. <br />Indemnification - Notwithstanding any other provision to the contrary, the Permittee agrees to Indemnify, defend <br />and hold harmless the County, Its officers, employees and agents for any and all claims arising out of the <br />Permittee's activities related to this Special Use Permit. <br />Insurance Requirements The Permittee agrees that In order to protect Itself, under the Indemnity provisions set <br />forth above, it will at all times during the term of this Special Use Permit keep In force policies of Insurance providing <br />the following checked -off liabilities, in an amount equal to the County's liability limits set forth in Minnesota Statute <br />Chapter 468 and the workers compensation requirements in Minn. Stat. Chapter 176, The Permittee agrees as a <br />condition subsequent to increase the required Insurance coverage as the liability limits in section 456.04 increase. <br />Nothing in this Special Use Permit shall constitute a waiver by the County of any statutory limits upon liability. Prior <br />to the effective date of this Special Use Permit, the Permittee will fumish the County with a current and,valid proof of <br />Insurance certificate indicating insurance coverage in the amounts required by this Special Use Permit, This <br />certificate of insurance shall be on file with the County throughout the term of the Special Use Permit. As a condition <br />subsequent to this Special Use Permit, Permittee shall insure that the certificate of Insurance provided to the County <br />will at all times be current. Any policy obtained and maintained under this clause shall provide that It shall not be <br />cancelled, materially changed, or not renewed Without thirty days notice thereof to the County. <br />® General Liability ® Automobile Liability ❑ Insurance Requirements Waived <br />Compliance with Law - The Permitee shall abide by all federal, state or local laws, statutes, ordinances, rules and <br />regulations now in effect or hereinafter adopted insofar as they relate to the provisions of this Special Use Permit. <br />Firearms Prohibited – Unless speoifioally required by the terms of this Permit, the Permittee, including but not <br />limited to employees, agents or subcontractors of the Permittee shall not carry or possess a firearm on County <br />premises. Violation of this provision shall be considered a substantial breach of the Permit: and, In addition to any <br />other remedy available to the County under law or equity.
