Washington County WATER CONSERVATION GRANT This Grant Agreement is made and entered into between County of Washington, State of Minnesota, hereinafter referred to as "County" and Cit_. of Hugo, 14669 Fitgerald Ave. N., Hugo, MN 55038, herein after referred to as "Grantee." WHEREAS, one -hundred percent of the source of drinking water in Washington County comes from groundwater; and WHEREAS, it is in the interest of the public's health, safety and welfare to preserve and protect groundwater, WHEREAS, in the current Washington County Groundwater Plan, the Washington County Board of Commissioners has recognized the need coordinate effort to develop sustainable groundwater management, including through water efficiency and conservation; and WHEREAS, MiNN. STAT. CHAPT. 145A authorizes the County to make expenditures to protect the health of its citizens; and WHEREAS, the County has applied to the County for Water Efficiency Grant funds. NOW, THEREFORE, it is mutually agreed between the County and County as follows: TERM The term of the Agreement shall be from date of final signature to December 31, 2017. II. THE COUNTY'S OBLIGATION: The County will provide to the grantee an allocation in the amount of $12,500 of the County's funds to fund the activities set forth in Section III below. III. THE GRANTEE'S OBLIGATIONS: The grantee will undertake the project in the attached scope of work. IV. GENERAL TERMS AND CONDITIONS: Data Privacy 1. All data collected, created, received, maintained or disseminated for any purposes by the activities of the County because of this Agreement is governed by the Minnesota Government Data Practices Act, Minnesota Chapter 13, as amended, the Minnesota Rules implementing such Act now in force or as adopted, as well as Federal Regulations on data privacy, including but not limited to, the Health Insurance Portability and Accountability Act (HIPAA) where it applies. 2015 Water Conservation Grant Page 1 of 4
