PAUL, MN 55101-1678 REPLY TO ATTENTION OF AUG 2 4 2016 REGULATORY BRANCH Operations Regulatory (2016-02345-LMG) The Excelsior Group c/o Ms. Deb Ridgeway 1660 Highway 100 South, Suite 400 St. Louis Park, Minnesota 55416 Dear Ms. Ridgeway: This letter is in response to your correspondence dated July 1, 2016, requesting Corps of Engineers (Corps) concurrence with the delineation of aquatic resources completed on a 17 acre parcel in the City of Hugo. The project site is located in Section 29, Township 31 North, Range 21 West, Washington County, Minnesota. We have reviewed the information provided in your report and determined that the limits of the aquatic resources have been accurately identified in accordance with current agency guidance including the Corps of Engineers Wetland Delineation Manual (1987 Manual) and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Northcentral and Northeast Region. This determination is only valid for the review area outlined in red on the enclosed figures labeled MVP-2016-02345-LMG Page 1 of 2 through Page 2 of 2. This concurrence may generally be relied upon for five years from the date of this letter. However, we reserve the right to review and revise our concurrence in response to changing site conditions, information that was not considered during our initial review, or off -site activities that could indirectly alter the extent of wetlands and other resources on -site. Our concurrence may be renewed at the end of this period provided you submit a written request and our staff are able to verify that the determination is still valid. The preliminary jurisdictional determination (JD) included with the delineation concurrence presumes that all of the aquatic resources identified in the review area subject to Corps of Engineers' jurisdiction under the Clean Water Act. Since the determination is considered preliminary it is not appealable under our administrative appeal procedures (33 CFR 331). If you prefer an appealable approved jurisdictional determination that verifies the jurisdictional status of the aquatic resources within the review area you may request one by contacting the Corps representative identified in the final paragraph of this letter. If this preliminary JD is acceptable, please sign and date both copies of the Preliminary Jurisdictional Determination Form and return one copy to the letterhead address within 15 days from the date of this letter.
