PAUL, MN 55101-1678 <br />REPLY TO ATTENTION OF AUG 2 4 2016 <br />REGULATORY BRANCH <br />Operations <br />Regulatory (2016-02345-LMG) <br />The Excelsior Group <br />c/o Ms. Deb Ridgeway <br />1660 Highway 100 South, Suite 400 <br />St. Louis Park, Minnesota 55416 <br />Dear Ms. Ridgeway: <br />This letter is in response to your correspondence dated July 1, 2016, requesting Corps <br />of Engineers (Corps) concurrence with the delineation of aquatic resources completed on a 17 <br />acre parcel in the City of Hugo. The project site is located in Section 29, Township 31 North, <br />Range 21 West, Washington County, Minnesota. <br />We have reviewed the information provided in your report and determined that the limits <br />of the aquatic resources have been accurately identified in accordance with current agency <br />guidance including the Corps of Engineers Wetland Delineation Manual (1987 Manual) and the <br />Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Northcentral and <br />Northeast Region. This determination is only valid for the review area outlined in red on the <br />enclosed figures labeled MVP-2016-02345-LMG Page 1 of 2 through Page 2 of 2. <br />This concurrence may generally be relied upon for five years from the date of this letter. <br />However, we reserve the right to review and revise our concurrence in response to changing <br />site conditions, information that was not considered during our initial review, or off -site activities <br />that could indirectly alter the extent of wetlands and other resources on -site. Our concurrence <br />may be renewed at the end of this period provided you submit a written request and our staff <br />are able to verify that the determination is still valid. <br />The preliminary jurisdictional determination (JD) included with the delineation <br />concurrence presumes that all of the aquatic resources identified in the review area subject to <br />Corps of Engineers' jurisdiction under the Clean Water Act. Since the determination is <br />considered preliminary it is not appealable under our administrative appeal procedures (33 CFR <br />331). If you prefer an appealable approved jurisdictional determination that verifies the <br />jurisdictional status of the aquatic resources within the review area you may request one by <br />contacting the Corps representative identified in the final paragraph of this letter. <br />If this preliminary JD is acceptable, please sign and date both copies of the Preliminary <br />Jurisdictional Determination Form and return one copy to the letterhead address within 15 days <br />from the date of this letter. <br />
