April 11, 2017 <br />Page 3 <br />Pond 9 has an outlet elevation of 927.0; the Wetland 2 boundary in this <br />location is about 928.0. <br />Pond 8 has an outlet elevation of 930.0; adjacent Wetland 2 is generally at a <br />930.0 elevation in this location. <br />Ponds 5, 6, and 7 have outlet elevations of 930.0 and 930.5, the adjacent <br />Wetland 2 boundary ranges between 930.0 and 932.0 in this area. <br />Pond 3 has an outlet elevation of 930.0; the Wetland 2 boundary nearest this <br />pond is at a 930.0 elevation. <br />3. Please provide an updated purchase agreement that shows the correct amount <br />of replacement credit and an extended expiration date. <br />Response: Attachment C includes the revised purchase agreement. <br />4. Please provide a more specific narrative on what flexibility is being requested <br />based on 8420.0520. In this narrative, please address 8420.0520 Subp. 3.A as <br />well. <br />Response: The applicant is requesting sequencing flexibility for 8420.0520 <br />Subp. LA as a second alternative that avoids all wetland impacts is not feasible <br />in the context of the Project because of the City requirement to extend 137th <br />Street east, then south through the site. With this requirement there is no <br />feasible alternative that entirely avoids wetland impacts. In addition, please <br />consider the following language regarding the basis for sequencing flexibility <br />as incorporated into Attachment C of the application: <br />"The Applicant is requesting sequencing flexibility for the 1.32 acres of impact to Wetlands 2 <br />and 3. Wetland 3, and the edges of Wetland 2 where impacts are proposed have been <br />degraded to a point where the proposed replacement will result in an overall gain in function <br />and public value. Wetland 3 is a Type 1/2, farmed wetland with marginal hydrology. Avoiding <br />Wetland 3 with the Project would further reduce the hydrologic support to the wetland, <br />resulting in further degradation in its ability to function and provide public value in the <br />developed landscape. The impact locations on Wetland 2 occur along disturbed edges which <br />are generally dominated by reed canary grass or on Type % farmed wetland portions of <br />Wetland 2." <br />The following text addresses 8420.0520 Subp.3.A <br />Blanding's Turtle have been documented in the vicinity of the Project. The <br />Project proposer is sensitive to the fact that state -listed (Threatened) Blanding's <br />turtles could potentially be found in the vicinity of the Project area, and is <br />therefore taking actions to avoid impacts to the species during and after Project <br />construction. <br />
