5.5 Maintenance, Repair, Replacement and Reconstruction. Each Unit, and the rights <br />of the Owners and Occupants thereof, other Neighborhood Property and the Master Common <br />Elements shall be subject to and benefited by nonexclusive easements in favor of the Master <br />Association for the maintenance, repair, replacement and reconstruction of the Master Common <br />Elements and utilities serving the Units, to the extent necessary to fulfill the Master <br />Association's obligations under the Master Governing Documents. Each Owner shall afford to <br />the Master Association and its management agents and employees, access at reasonable times <br />and upon reasonable notice, to and through the Unit for maintenance, repair and replacement; <br />provided that access may be had without notice and at any time in case of emergency. <br />5.6 Emergency Access to Units. In case of emergency, all Units are subject to an <br />easement, without notice and at any time, in favor of the Master Association for access by the <br />Master Association's management agents, and in favor of fire, police or other public safety <br />personnel. <br />5.7 Project Signs. The Master Developer and the Master Association shall have a <br />non-exclusive easement and right to erect and maintain temporary and permanent signs and <br />related landscaping, fencing, monuments and related improvements identifying the Property or a <br />Neighborhood on and over the Master Common Elements, the Neighborhood common elements <br />and those parts of the yard areas of Units designated or reserved for the placement of signs. <br />Those parts of the Master Common Elements on which permanent monument signs or related <br />improvements are located shall be subject to non-exclusive easements in favor of the Master <br />Association for the continuing use, maintenance, repair and replacement of said signs and <br />improvements. <br />5.8 Master Developer Rights. The Units, other Neighborhood Property and the <br />Master Common Elements are subject to exclusive easements in favor of the Master Developer <br />for the exercise of its Master Developer Rights as described in the Master Governing <br />Documents. Easements in favor of the Master Developer shall terminate only upon the <br />voluntary, written surrender of the easement right or at such time as the Master Developer no <br />longer owns a Unit for sale or has the right to add Additional Property to the Property. <br />5.9 Other Easements. The Property shall be subject to such other easements as may <br />be authorized by the Master Association under authority contained in the Master Governing <br />Documents or MCIOA or recorded against the Property by reason of the requirements of any <br />governmental authority having jurisdiction over the Property in connection with the development <br />of the Property or Additional Property. <br />5.10 Continuation, Scope and Conflict of Easements. The easements set forth in this <br />Section (i) shall run with the land and shall be appurtenant to the benefited Property; (ii) shall <br />supplement and not limit any easements described elsewhere in this Master Declaration, or <br />otherwise recorded; (iii) shall be permanent, subject only to termination in accordance with the <br />terms of the easement; and (iv) shall include reasonable access to the easement areas over and <br />through the Property for purposes of construction, maintenance, repair, replacement and <br />reconstruction. <br />5.11 Non Interference; Impairment Prohibited. All Persons exercising easement rights <br />shall do so in a reasonable manner so as not to materially interfere with the operation of the <br />Property or cause damage to the Property, and shall be financially liable for all costs of repair of <br />13 <br />2190398.v1 <br />
