6.5 Limited Master Assessments. In addition to annual Master Assessments, special <br />Master Assessments and Neighborhood Assessments, the Master Board may levy and allocate a <br />limited Master Assessment among one or more, but not all, Members or Units in accordance <br />with the following requirements and procedures: <br />6.5.1 Any Master Common Expense benefiting fewer than all of the Units in a <br />Neighborhood may, at the Master Board's discretion, be assessed against that <br />Neighborhood as provided in Section 6.4 or directly against the Unit or Units benefited <br />equally, by actual cost per Unit or such other reasonable allocation as may be approved <br />by the Master Board or authorized in the Neighborhood Governing Documents of such <br />Neighborhood. <br />6.5.2 Reasonable attorney's fees and other professional fees and costs incurred <br />by the Master Association in connection with (i) the collection of Master Assessments, <br />and (ii) the enforcement of the Master Governing Documents and the Neighborhood <br />Governing Documents against a Member or an Owner or Occupant or their guests, may <br />be assessed against the Member or the Owner's Unit, as the case may be. <br />6.5.3 Late charges, fines and interest may be assessed as provided in <br />Section 11.2. <br />6.5.4 If damage to the Master Common Elements, Neighborhood Property or <br />another Unit is caused by the act or omission of any Owner or Occupant, or their guests, <br />the Master Association may assess the costs of repairing the damage exclusively against <br />the Owner's Unit to the extent not covered by insurance. <br />6.5.5 The costs of maintenance performed by the Master Association as result of <br />the failure of a Neighborhood Association, Owner or Occupant to perform such party's <br />maintenance obligations as set forth herein or in the relevant Neighborhood Governing <br />Documents may be assessed against the responsible Neighborhood Association, Owner <br />or Occupant in accordance with Section 9.2.5. <br />6.6 Master Assessment Procedures. The following procedures shall govern the <br />levying of Master Assessments: <br />6.6.1 In accordance with the Master Bylaws, the Master Board shall annually <br />approve a Master Association budget, and shall allocate and levy annual Master <br />Assessments against the Neighborhood Associations in accordance with the requirement <br />of this Master Declaration. Special Master Assessments may be levied at any time. <br />Neighborhood Assessments and limited Master Assessments may be levied at any time; <br />however, to the extent that a Neighborhood Assessment or limited Master Assessment <br />can be budgeted prior to the start of the Master Association fiscal year, they shall be <br />levied at the same time as the annual Master Assessment. A Master Assessment may be <br />prorated for a partial year. Notice of a Master Assessment shall be given to the <br />Neighborhood Associations in accordance with the Master Bylaws. <br />6.6.2 The share of each Master Assessment levied against a Neighborhood <br />Association shall promptly be levied and allocated by the Neighborhood Board among <br />16 <br />2190398.v1 <br />
