8.4 Application and Approval Required. Except as otherwise authorized by this <br />Section 8, no Improvement shall be constructed, erected, removed, planted or maintained, nor <br />shall any addition to or any change, replacement or alteration thereof be made, until plans and <br />specifications showing the nature, kind, shape, height, materials, floor plans, color scheme and <br />location of the Improvement shall have been submitted to and approved in writing by the Design <br />Reviewer. <br />8.4.1 Approval shall be requested by written application on such forms as may <br />be required by the Design Reviewer, and in compliance with the following requirements <br />unless waived in writing by the Design Reviewer. Two complete sets of plans and <br />specifications, including site survey, prepared by an architect, landscape architect, <br />engineer or other person found to be qualified by the Design Reviewer shall be <br />submitted. The site survey shall show the proposed topography of the Property to be <br />improved or altered in one foot contours with other relevant elevation information and all <br />proposed structures, driveways, easements, patios and other hard surfaces and grading. <br />The Design Reviewer may require submission of samples of building materials and <br />colors proposed to be used. The applicant shall also apply for approval to the City or <br />other governmental authority having jurisdiction over the subject of the application, if <br />required by the governmental authority. If the information submitted to the Design <br />Reviewer is, in the Design Reviewer's sole opinion, incomplete or insufficient in any <br />manner, the Design Reviewer may require the submission of additional information. <br />8.4.2 Subject to any specific requirements or exceptions contained in this <br />Section 8, the Design Reviewer shall have the exclusive right to approve or disapprove <br />all proposed additions or any other Improvements or changes to the exterior of any <br />Dwelling, Building or other Improvement, including but not limited to the size, exterior <br />design, color, materials, landscaping and location with respect to all Improvements, as <br />well as the general plan for the overall development of any Neighborhood. <br />8.4.3 In reviewing each application, the Design Reviewer may consider any <br />factors it deems relevant, including but not limited to harmony of the proposed external <br />design with surrounding structures and environment. Decisions may be based on purely <br />aesthetic considerations. Each Owner acknowledges that such determinations are purely <br />subjective and that opinions may vary as to the desirability and/or attractiveness of <br />particular Improvements. <br />8.4.4 The Design Reviewer may, in its sole discretion, impose standards for <br />design, appearance, construction, or development which are greater or more stringent <br />than standards prescribed by the Master Governing Documents, the Design Guidelines, or <br />by building, zoning, or other governmental laws, codes, or regulations; provided that such <br />standards shall be consistent with the architectural character and use of the Property as <br />planned and developed by the Master Developer. <br />8.5 General Standards For Review. The Design Reviewer has authority to approve, <br />conditionally approve or deny an application, in its sole and absolute discretion.
