April 12, 2017 <br />Page 4 <br />Contractors, and homeowners, working or living within the project area will be provided the <br />DNR's Blanding's turtle flyer so they are aware what the species looks like, and what to do <br />should an animal be encountered. <br />The project will also be required to adhere to the Stormwater Pollution Prevention Plan <br />(SWPPP), and actively monitored during construction. Construction zones will be cordoned off <br />with silt fence and monitored for turtles by SWPPP and construction staff. Open trenches will <br />be inspected prior to backfilling, and the DNR will be immediately notified of any turtle <br />sightings. Turtles will be moved by hand, out of harm's way, if they are in imminent danger. <br />Turtles not in imminent danger will be left undisturbed. <br />In addition, the project proposer will evaluate use of wildlife -friendly erosion control products to <br />prevent animals from being entangled during construction. <br />Comment 4: <br />The EAW references an incorrect ERDB number for the NHIS review letter that is included in Appendix C. <br />For future reference, the correct number is 20160443. <br />Response: <br />Noted for the record. <br />Comment 5: <br />Appendix C includes an "Eagle Nest Assessment Summary" dated July 2016. This summary indicated that <br />bald eagles were observed in the project vicinity, however no eagle nests were observed within the project <br />boundary at the time of the survey. It is unclear if all tree clearing activities related to this project will occur at <br />one time, or during multiple phases of the project (extending out to 2021). As such, the DNR recommends that <br />trees be surveyed for eagle nests each year, prior to any tree cutting activities. <br />Response: <br />Tree clearing will likely occur with grading in two separate phases. As recommended, the <br />project proposer will review the previous nest survey prior to each tree removal event to ensure <br />eagles have not moved into the project area since the previous survey. Should an eagle's nest <br />be discovered on the project area, the project proposer will notify the DNR. <br />Comment 6: <br />Page 3 notes that the Comprehensive Plan calls for two future wells to be located outside of the project <br />boundary. As a reminder, the City of Hugo will need to submit a "Well Construction — Preliminary Assessment" <br />request to the DNR for the location and depth of each of the two proposed wells. Depending on results of our <br />review, the locations and aquifers for each of the proposed wells may need to be changed and the City of Hugo <br />may be required to conduct aquifer tests and construct observation wells for measuring the impacts of water <br />use on the aquifers as a result of these wells. After the wells have been constructed, the DNR Water <br />Appropriation Permit for the City of Hugo Water Supply System will need to be amended to reflect the existence <br />of the new wells. <br />Response: <br />It is not anticipated that a new well will need to be constructed with this development. The City <br />is currently updating its Comprehensive Plan and will evaluate whether the number or proposed <br />locations of any wells will change from the last update. When a well is deemed necessary based <br />on the City's maximum daily demand, the City will follow the appropriate procedures for <br />assessing the location and constructing the well, including conducting aquifer tests and placing <br />observation wells, as necessary. <br />K:\03288-040\Admin\Dots\EAW\EAW Responses to Comments 041217.docx <br />
