Agenda N umber G10 <br />CITY OF HUGO COMMUNITY <br />DEVELOPMENT DEPARTMENT <br />M emorandum <br />TO: Bryan Bear, City Administrator <br />FROM: Rachel Leitz, Community Development Assistant <br />SUBJECT: Swi mmi ng Pool Ordinance <br />DATE: June 1, 2017 for the Council Meeting of June 5, 2017 <br />1. PLANNING COMMISSION UPDATE: <br />At its May 25, 2017 meeting, the Planning Commission held a public hearing and considered the <br />swimming pool ordinance. The Planning Commission had general questions on the required <br />setbacks for noise making mechanical equipment. They requested staff to review the <br />requirements and consider lessening the setback if further noise proofing is approved by City <br />staff. <br />Since the Planning Commission meeting, staff has reviewed the setbacks for noise making <br />mechanical equipment. Staff has added a provision that setback requirements for noise making <br />mechanical equipment may be minimized if the applicant can demonstrate sufficient noise <br />proofing by other methods. This shall be reviewed and approved by City staff. <br />2. BACKGROUND: <br />City staff has been receiving many inquiries regarding Hugo's swimming pool requirements. <br />The City does not have an official ordinance related to these requirements and has been <br />following building code requirements and setbacks related to accessory structures when <br />swimming pools are submitted for review. In discussions with residents and swimming pool <br />installers/professionals, the City's setback requirements didn't accommodate for a reasonably <br />sized pool or created an unusual site plan, which didn't allow residents to fully utilize their back <br />yards. Because of these difficulties, staff was approached by many residents who wanted to <br />discuss the variance process to accommodate their swimming pools. <br />On February 9, 2017 City staff approached the Ordinance Review Committee (ORC) to discuss <br />swimming pool requirements in Hugo, specifically related to setbacks, impervious surface, and <br />location of noise making units. The ORC agreed that staff should begin drafting a swimming <br />pool ordinance to address the number of variance requests the City was receiving. On March 6, <br />2017 City Council approved staff to begin preparing a swimming pool ordinance. <br />
