MINUTES <br /> HUGO BOARD OF ZONING=APPEALS AND'ADJUSTMENTS <br /> Chairperson Schumann called the meeting to order at 6:34 p.m. <br /> PRESENT: Brunotte, Puleo, Schumann <br /> ALSO PRESENT: John Rask, Community Development Director <br /> Michele Lindau, Secretary <br /> Minutes of July 11, 2002 <br /> Puleo made motion, Schumann seconded, to approve the minutes of July 11, 2002 as presented. <br /> All Ayes. Motion carried. <br /> Radebaugh Variance for Fence <br /> The Board held a public meeting to consider the request of Craig and Sharon Radebaugh for a <br /> variance to allow a six-foot high privacy fence in a front yard on property located at 4868 1291h <br /> Street North. The property is a corner lot and has two front yards. The home faces 129 'Street <br /> and the fence would be to the rear of the home along Europa Trail. The zoning ordinance <br /> prohibits six-foot high privacy fences in a front yard. A front yard is defined as the yard between <br /> the home and a public street. <br /> Staff found the hardship to be unique to the property because the property was a corner lot. Staff <br /> also found it would be keeping with the spirit and intent of the ordinance because the fence <br /> would be located in the rear yard of the home. <br /> Other than the applicant, there was no one there from the public to comment on the application. <br /> Brunotte made motion, Puleo seconded to recommend approval of the variance with the <br /> condition the applicant enter into an encroachment agreement to allow the fence within the <br /> drainage and utility easement, and the applicant provide a 3 to 4 inch gap between the bottom of <br /> the fence and the ground for that portion of the fence that runs along the north property line. <br /> All Ayes. Motion carried. <br /> Adiournment <br /> Brunotte made motion, Schumann seconded, to adjourn at 6:46 pm. <br /> All Ayes.
