r An easement for public utility improvements with the right to enter upon the real estate hereinafter described at any time that it may see fit, and construct, maintain and repair any lines, equipment, materials, or other items for public utility purposes, for the purpose of maintaining, repairing or replacing the said public utilities over, across, through and under the lands hereinafter described, together with the right to excavate and refill ' ditches and/or trenches for the location of said public utilities, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering in the location, construction and maintenance of said public utilities. The party of the second part shall reestablish vegetation in any areas it disturbs. The party of the first part shall be permitted to install and maintain fencing within the easement. The party of the second part shall repair or replace to equal condition any fence damaged or removed by its activities. That said public utility easement located in the County of Washington, State of Minnesota, is described as follows, to -wit: The North 400.00 feet of the West 60.00 feet of the Northwest Quarter of the Northeast Quarter of Section 32, Township 31, Range 21, Washington County, Minnesota. (see attached Exhibit A of the easement area). The party of the first part does hereby covenant with the party of the second part, that they are lawfully seized and possessed of the real estate above described.
