r <br />An easement for public utility improvements with the right to enter upon the real estate <br />hereinafter described at any time that it may see fit, and construct, maintain and repair any lines, <br />equipment, materials, or other items for public utility purposes, for the purpose of maintaining, <br />repairing or replacing the said public utilities over, across, through and under the lands hereinafter <br />described, together with the right to excavate and refill ' ditches and/or trenches for the location of <br />said public utilities, and the further right to remove trees, bushes, undergrowth, and other <br />obstructions interfering in the location, construction and maintenance of said public utilities. The <br />party of the second part shall reestablish vegetation in any areas it disturbs. <br />The party of the first part shall be permitted to install and maintain fencing within the <br />easement. The party of the second part shall repair or replace to equal condition any fence damaged <br />or removed by its activities. <br />That said public utility easement located in the County of Washington, State of Minnesota, <br />is described as follows, to -wit: <br />The North 400.00 feet of the West 60.00 feet of the Northwest <br />Quarter of the Northeast Quarter of Section 32, Township 31, <br />Range 21, Washington County, Minnesota. <br />(see attached Exhibit A of the easement area). <br />The party of the first part does hereby covenant with the party of the second part, that <br />they are lawfully seized and possessed of the real estate above described. <br />IN WITNESS WHEREOF, the said parties have caused this instrument to be executed the <br />day and year first above written. <br />IN PRESENCE OF: PARTY OF THE FIRST PART: <br />7 <br />
