Ordinance 2016-484 regulates swimming pools <br />in Hugo. The following sections have been added or amended: <br />1. Chapter 90, Article I, Sec. 90-1. — Definitions <br />a. Amending the definitions to include the additions of the following: <br />L Swimming Pool, In -Ground Swimming Pool, Above Ground Swim- <br />ming Pool, Small Above Ground Swimming Pool, and Large Above <br />Ground Swimming Pool. <br />2. Chapter 90, Article VI — Requirements for Specific Uses and Per- <br />formance Standards <br />a. Adding Section 90-279. - Swimming Pools, to include: <br />I. General standards for all swimming pools, including; <br />1. Building permit requirements for all in -ground swimming <br />pools and above ground swimming pools with a capacity over <br />5,000 gallons and/or wall height over 42 inches. <br />2. Noise -making mechanical equipment screened from view <br />and a minimum of 30 ft. from nearby dwellings. <br />if. In -Ground swimming pools, including: <br />1. Required submittal information for building permit applica- <br />tions. <br />2. Property line setbacks: 15 ft. rear yard setback, 10 ft. side <br />yard setback, 6 ft. setback from principle structure or frost <br />footing. <br />3. Well/Septic setbacks: 20 ft. from well. 10 ft. from septic. 20 ft. <br />from soil treatment area. <br />4. Requirement for a fence or wall with a self-closing and <br />self -latching gate. <br />iii. Above Ground swimming pools, including: <br />1. Differentiation between "large" and "small" above ground <br />pools. <br />2. Property fine setbacks: 30 ft. rear yard setback, 10 ft. side <br />yard setback, 6 ft. from any principle structure or frost footing. <br />3. Required submittal information for building permit applica- <br />tions. <br />4. Large above ground swimming pools require fence or wall <br />with a self-closing and self -latching gate. <br />5. Small above ground swimming pools not surrounded be a <br />fence must have a removable ladder that is removed when <br />the pool is not in use. <br />Please note this title and summary of this Ordinance clearly informs the <br />public of the intent and effect of the Ordinance and conforms to Minn. Stat. <br />§ 412.191.
