Encroachment agreement to locate an accessory <br />structure within a drai nage and uti I i ty easement on the property located at <br />15995 Fi nl ey Avenue North. <br />DATE: August 15, 2017 for the Council Meeting of August 21, 2017 <br />1. PROPOSED MOTION: <br />Receive approval of an encroachment agreement for Christopher Clausen for an accessory <br />structure located at 15995 Finley Avenue North for signature by Mayor and City Clerk. <br />2. OVERVIEW: <br />The applicant is requesting to construct a 256 square foot accessory structure to be located in the <br />rear yard. This property is a large residential property at .52 acres and has a drainage and utility <br />easement that covers the majority of the rear yard, beginning 10 ft. from the back of the home. <br />The drainage and utility easement covers a large wetland complex in the Creekview Preserve <br />development. The accessory structure would be located approximately 33 feet from the rear <br />property line and approximately 36 feet from the north side property line. There is a ditch that <br />runs through the applicant's property and staff has requested the structure be setback at least 15 <br />feet from the top of the ditch for future maintenance. Staff finds that the placement of the <br />accessory structure would have no negative impact on utilities or drainage in the area. <br />3. STAFF RECOMMENDATION: <br />Staff recommends that the City Council approve an encroachment agreement for Christopher <br />Clausen for an accessory structure located at 15995 Fi nl ey Avenue North. <br />ATTACHMENTS: <br />1.
