WAIVER OF RELOCATION BENEFITS <br /> THIS WAV ,ER OF RELOCATION BENEFITS ("Waiver") is made this day of <br /> 2006 by CHARLES J.NOSIE AND MARK S.NOSIE <br /> RECITALS <br /> WHEREAS, Seller has indicated that they desire to sell and THE CITY OF HUGO, a <br /> Minnesota municipal corporation ("Hugo") desires to buy real property located in the City <br /> of Hugo, Washington County, Minnesota, legally described on Exhibit A, attached hereto <br /> (the"Property"). <br /> WHEREAS, Minn. Stat. § 117.521 provides that an owner of real property, <br /> regardless of the owners intention to sell, who is entitled to relocation benefits may waive <br /> any benefits for which they are eligible under Chapter 117 of Minnesota Statutes and <br /> Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, United <br /> States Code, title 42, sections 4601 to 4655, as amended by the Surface Transportation and <br /> Uniform Relocation Assistance Act of 1987, Statutes at Large, volume 101, pages 246 to <br /> 256(1987), as amended("URA")(collectively, "Relocation Benefits"). <br /> WHEREAS,Hugo is only willing to purchase the Property if Seller agrees to waive <br /> any Relocation Benefits for which they may be eligible. <br /> WHEREAS, Seller has agreed to waive any Relocation Benefits which they may be <br /> eligible for. <br /> NOW, THEREFORE, in consideration of the foregoing Recitals, Seller states as <br /> follows: <br /> WAIVER: <br /> 1. Recitals. The above Recitals are incorporated herein as if fully set forth <br /> herein. <br /> 2. Acknowledgment. Seller acknowledges that they have been advised that <br /> if Hugo acquires a parcel of land, Seller may have been eligible for relocation payment <br /> and other payments under the URA. <br /> 3. Benefits. Seller understands that the URA provides for advisory <br /> assistance, including referral to comparable (affordable, decent, safe and sanitary) <br /> replacement housing; for payment of actual, reasonable moving and related expenses or <br /> for a fixed expense or dislocation allowance, at Seller(s)' election; and in addition, for a <br /> replacement housing payment which may be up to $22,500 to purchase or $5,250 in rent <br /> assistance to assist Seller(s) in buying or renting a replacement business location. <br /> 4. Sale Contingent Upon Waiver. Seller has been advised that the Hugo <br /> will only acquire the Property if Seller(s) agree to waive their rights to relocation under <br /> C-1 <br />
