(4) The Developer will cooperate with the City with respect to any litigation <br /> commenced with respect to the Project to the extent the City and the Developer are not adverse <br /> parties in such litigation. <br /> (5) The Developer will cooperate with the City in resolution of any traffic, <br /> parking, trash removal or public safety problems which may arise in connection with the <br /> construction of the Project. <br /> (6) The County assessor estimates the current year estimated market value of <br /> the Development Property to be $654,500. The Developer represents that the cost of site <br /> preparation for the Development Property will be not less than $291,610 and the purchase price <br /> for the Development Property was not less than $1,070,000. Based upon these estimates and <br /> representations, the Developer represents that because the Developer's investment in the <br /> purchase of the site and in site preparation for the Development Property will equal $981,610 <br /> ($1,361,610 less $380,000) which is seventy percent (70%) or more of the County assessor's <br /> current year's estimated market value of the Development Property, the Tax Abatement Program <br /> described in this Agreement does not constitute a "business subsidy" and is not subject to the <br /> Business Subsidy Law, Minnesota Statutes, Section 116J.993 through 116J.995. <br /> 2212455v4 5 <br />
