PARKING AND TEMPORARY CONSTRUCTION EASEMENT AGREEMENT <br /> THIS PARKING AND TEMPORARY CONSTRUCTION EASEMENT <br /> AGREEMENT ("Easement") is entered into this _day of May, 2009, by and between <br /> THE CITY OF HUGO, a Minnesota municipal corporation ("City"), and SWANY OF <br /> HUGO, INC., a Minnesota corporation ("Swany") and CATHERINE E. ANDERSON, <br /> a single person("Anderson"). <br /> RECITALS <br /> A. City is the owner of real property located in Washington County, <br /> Minnesota and legally described on the attached Exhibit A(the "City Property"). <br /> B. Swany is the owner of real property located in Washington County, <br /> Minnesota and legally described on the attached Exhibit B (the "Swany Property"). <br /> C. Anderson is the owner of real property located in Washington County, <br /> Minnesota and legally described on the attached Exhibit C (the "Anderson Property") <br /> D. Swany and Anderson desire to obtain a non-exclusive easement for <br /> parking and a temporary easement for construction of a parking lot (the "Parking Lot") <br /> over a portion of the City Property depicted on the attached Exhibit D and legally <br /> described on the attached Exhibit E (the"Easement Area") and maintaining a parking lot. <br /> E. City desires to grant such easements to Swany and Anderson according to <br /> the terms and conditions hereinafter set forth. <br /> NOW, THEREFORE, in consideration of the foregoing recitals and other good <br /> and valuable consideration, the receipt of which is hereby acknowledged the following <br /> easements are hereby created as hereinafter provided and subject to the following terms <br /> and conditions: <br /> AGREEMENT <br /> 1. Recitals. The foregoing Recitals are hereby incorporated as if fully set <br /> forth herein. <br /> 2. Creation of Easements. <br /> 2.1 Grant of Temporary Construction Easement. The City hereby <br /> grants and conveys to Swany and Anderson a temporary easement for the <br /> purposes of constructing the Parking Lot, over and across the Easement Area. <br /> The term of this temporary construction easement shall expire upon the earlier of <br /> May_, 2010 or upon striping of the parking lot. <br /> 2.2 Grant of Parking Easement. The City hereby grants and conveys <br /> to Anderson a non-exclusive easement for parking for non-commercial vehicles <br /> for the benefit of and appurtenant to the Swany Property and Anderson Property, <br /> across, over and under and upon the Easement Area (the "Parking Easement"). <br /> 4- <br />
