the City Property and the Swany Property and Anderson Property, respectively, only with <br /> respect to events and claims occurring or accruing during said owner's tenure of <br /> ownership of the City Property or Swany Property or Anderson Property. <br /> 13. Attorney Fees. If an action is commenced to enforce or to recover <br /> damages for the breach of any of the provisions of this Agreement, or because of a breach <br /> or threatened breach of any provisions hereof, the prevailing party shall be entitled to <br /> recover reasonable attorney fees, costs and expenses incurred in connection with the <br /> prosecution or defense of such matter. <br /> 14. Captions, Heading. The heading captions of the sections or paragraphs of <br /> this Easement are set forth for convenience only and are not to be considered in <br /> interpreting this Easement. <br /> 15. Governing Law.
