Hugo City Council Meeting Minutes for August 21, 2017 <br />Page 4 of 6 <br />appointed in 2001 for a three year term. The Finance Department has been very pleased with <br />their work and the Council has approved four contract extensions since. Adoption of the <br />Consent Agenda approved Smith Schafer & Associates as the City's auditor for 2017-2021 <br />subject to the terms in the proposal submitted to the City. <br />Approve Encroachment Agreement at 15995 Finley Ave N for Accessory Structure <br />Christopher Clausen, 15995 Finley Avenue North, had applied for an Encroachment Agreement <br />to locate an accessory structure within a drainage and utility easement. Adoption of the Consent <br />Agenda approved RESOLUTION 2017-29 APPROVING AN ENCROACHMENT <br />AGREEMENT FOR CHRISTOPHER CLAUSEN TO ALLOW CONSTRUCTION OF AN <br />ACCESSORY STRUCTURE WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE <br />PROPERTY LOCATED AT 15995 FINLEY AVENUE NORTH. <br />Discussion on DNR's Public Waters Reclassification of Hardwood Creek <br />At the City Council meeting on August 7, 2017, Rice Creek Watershed District Board Manager <br />John Waller spoke to Council on the Department of Natural Resources' decision to put segments <br />of Hardwood Creek back into the public waters inventory. He had requested the Council send a <br />letter to the DNR in opposition. <br />City Administrator Bryan Bear provided a map that showed the ditches in the area and what they <br />were classified as, specifically the segment from Henna Avenue west to Elmcrest Avenue, <br />known as Judicial Ditch 2. He explained that the DNR created an inventory of public waters in <br />1979 after a process that included public input. The inventory included a list and a map. These <br />were reviewed after the Buffer Law was created in 2015, and it was found that some ditches <br />were included on the map as public waters but were not on the list, and segments of Hardwood <br />Creek QD2) only showed on the map. <br />In April, the DNR had ordered the ditches not on the list to be removed from the public waters <br />inventory since proper notice was not provided to those landowners; the public process was not <br />followed. Since then, RCWD was notified by the DNR of their intention to put those segments <br />back on the public waters list. The RCWD sent a letter to the DNR informing them they would <br />like the original statutory process to be followed. Bryan stated that inclusion in the public waters <br />inventory could have consequences to landowners, City, and RCWD. He suggested that staff <br />have a conversation with the DNR to inquire on their intended process, and then follow-up with <br />a letter. •880, <br />Petryk made motion, Klein seconded, to direct staff to contact the DNR to inquire about the <br />intended process and follow up with a letter. <br />All Ayes. Motion carried. <br />Yellow Ribbon Network Update <br />Council Member Chuck Haas and Council Member Phil Klein reported to Council on the Yellow <br />Ribbon Network activities held recently.
