in the developer's agreement. Erosion control measures will be consistent with <br />Best Management Practices as outlined by the Minnesota Pollution Control <br />Agency. This measure has been followed. <br />32. The filling of large areas of unsuitable soil for residential construction will not <br />be permitted within the study area. This measure has been followed and will <br />continue to apply. <br />33. The City does not intend to discharge untreated stormwater to natural wetland <br />complexes or designated stream corridors as part of development within the <br />study area. However, if impacts to wetlands are proposed as part of <br />development, they will be evaluated in accordance with the Wetland <br />Conservation Act. This measure has been followed and will continue to <br />apply. <br />34. City policy and the Rice Creek Watershed District (RCWD) require that post - <br />development discharge rates not exceed pre -development discharge rates. <br />Development will be required to meet these standards. This measure has been <br />followed and will continue to apply. <br />35. The City will work with the District to address the District's interest in <br />providing volume control standards to the two-year, 24-hour rainfall event. <br />This measure has been followed where soil conditions allowed. With the <br />new 2017 RCWD Rules, the City will follow the 2017 RCWD Rules for new <br />development to implement volume control standards of up to 1.1 -inch of <br />runoff from new impervious surfaces. The City will continue to work with <br />RCWD to renew the joint Memorandum of Understanding transferring the <br />permitting authority to the City. <br />36. The stormwater management plan outlined in Option C will be implemented by <br />the developers with oversight and review provided by the City. Through the <br />use of this large, centralized, regional stormwater management system in <br />combination with some on-site ponding, discharge rates can be maintained at <br />pre -development rates for the study area, including the collector roadways. <br />This measure has been followed and will continue to apply. <br />37. The developer shall be responsible to make certain that the site is graded <br />appropriately to ensure adequate stormwater management is available to the <br />extent necessary and will be required to obtain the necessary permits for <br />stormwater management and grading. This measure has been followed and <br />will continue to apply. <br />38. The RCWD requires stormwater treatment and infiltration. Any new <br />development is required to meet the most updated rules of the RCWD.
