9.1 LESSOR shall provide for the general maintenance of LESSOR'S Property, and <br />Communications Facility, including obstruction lights, if any, inspections and any other <br />measures necessary to maintain the safety and utility of LESSOR'S Property. LESSOR <br />agrees to maintain LESSOR'S Property in strict accordance with all local, state and <br />federal rules and regulations This shall include, but not be limited to, weed control, <br />tower lights, tower lighting alarm system, lighting. monitoring and any other FCC or FAA <br />mandated codes. <br />9.2 LESSOR shall, upon execution of this Lease, provide LESSEE with access to the <br />secured Communications Facility door and the name, address and telephone numbers <br />of LESSOR'S Facility Supervisor, who shall be LESSEE'S day-to-day contact person for <br />resolution of equipment issues and other technical issues that may arise during the term <br />of the Lease. <br />10. DUTIESOF LESSEE <br />10.1 Taxes LESSEE shall be responsible for the payment of taxes, and any penalties, <br />interest or late charges, levied upon the Communications Facility, ifany, due to <br />LESSEE'S use of the Communications Facility. Said taxes shall be paid directly to the <br />taxing authority. Any taxes paid are in addition to the Fee set forth in Clause 4 above. <br />10.2 Changes to ,LESSEE'S Equipment Any future changes to LESSEE'S antenna, cabling <br />or related equipment, as well as any changes of wattage, frequency or functionality of <br />LESSEE'S communication equipment, whether or not said alterations affect the Fees <br />payable under this Lease or require one-time payments by LESSEE for engineering <br />studies, plan review, modifications to the Communications Facility or any other reason, <br />shall be included herein by Amendment hereto. <br />10.3 Modifications LESSEE shall notify LESSOR'S Authorized Agent and secure written <br />approval for LESSEE, its employees, contractors or consultants to proceed prior to <br />installing, replacing or modifying any equipment including antenna cabling, changes in <br />wattage, frequency or functionality at the Communications Facility. Said notice shall be <br />given to LESSOR at :least forty-eight (48) hours in advance prior to commencement of <br />scheduled work. <br />10.4 In the case of emergency work, LESSEE shall immediately commence work and <br />LESSEE shall notify LESSOR as soon as practicable after commencement of the work. <br />10.5 Interference LESSEE warrants that LESSEE'S use of the Communications Facility <br />shall not interfere with LESSOR'S or any other tenant(s) that are on the <br />Communications Facility prior to the effective date of this Lease. In the event there is <br />interference, LESSEE shall promptly shut down that portion of its equipment causing <br />the interference, except for intermittent testing, until the interference is corrected. If at <br />any time there is future use of the Communications Facility by any other user, LESSOR <br />shall' have the responsibility to order the operator of the newly -added equipment to <br />promptly shut down that portion of its equipment causing the interference, except for <br />Agreement No. 20.17 -CE -Hugo Hugo Water Tower <br />Page 6 of 19 <br />
