RESOLUTION 2017-40 <br />APPROVING A CONDITIONAL USE PERMIT FOR KEVIN MURAMATSU TO <br />ALLOW RETAIL SPACE FOR THE PROPERTY LOCATED AT 5611 152ND STREET <br />NORTH, UNIT #3 <br />WHEREAS, Kevin Muramatsu has requested approval of a conditional use permit to allow up to <br />25 percent of retail space for the property located at 5611 152nd Street North, Unit #3. <br />WHEREAS, the property is legally described as follows: <br />Lot 5, Block 1, Husnik Industrial Park, Washington County, Minnesota <br />WHEREAS, the Planning Commission has considered the request on October 12, 2017, at a duly <br />called a public hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit to <br />allow up to 25 percent of retail space for the property located at 5611 152nd Street North, Unit <br />#3, subject to the following findings: <br />1. The proposed use is allowed by conditional use permit. <br />2. The proposed use is allowed in the I-3 zoning district and will keep with the spirit and <br />intent of the ordinance, which is intended to allow applicants the ability to offer a small <br />area of retail, rental, or service to accompany the primary use of their business. The <br />proposed use is compatible with the surrounding development and will not alter the <br />character of the area. <br />3. The proposed use as adequate drainage, water supply, and utilized to the site. <br />4. The property has adequate access to both Francesca Avenue N. and 152nd Street N. <br />5. The proposed use would not obstruct the floodplain or increase the potential for flooding. <br />6. The proposed use would not damage or reduce the benefits from any public waters. <br />7. The proposed use would not involve the use of watercraft on public waters. <br />8. The proposed use would not be visible from public waters. <br />9. The proposed use does not impact any wetlands <br />
